As New? Used?

I have noticed an increasing number of items being listed under the 'New' heading, when in fact they are used. Sellers seem to be increasingly saying 'this is listed as 'new' but it has been used/worn a few times but is 'as new'. This is somewhat incorrect in my view - a pair of shoes worn twice can be very 'used' whereas a DVD watched once may well still be 'as new' - except the cellophane is removed. All my own items are clearly stated as new or used - and I would never list something being New when it isn't!. Buyers need to be very aware of exactly what is being sold - I strongly suggest that specific questions are asked and requests for more photos are made - if the seller doesn't respond, it is likely there is something dodgy going on! Sadly, people want to get rid of their items (particularly now there is a worldwide economic downturn/recession) so seem to be using any selling means they can to catch a buyer; ALL buyers beware- any uncertainty of any kind - do not buy. Ask as many questions as you need to be sure. That way, what you think you are buying - should be.
