Buyer Beware the imortance of checking seller feedback

The Problem

It's the first time I've been officially scammed by an ebay seller and I'm angry and have learnt a valuable lesson.

I purchased a dress on 9th October 2009 from ebay UK seller lolitashedevil the sellers listing states that will only send via International Signed for postage as she has been burned before. I didn't question that, it's a secure way to send overseas to Australia and I happily paid the 7 pounds postage to Australia.

Unfortunately this item was posted during the UK postage strike so I allowed a month for the item to arrive. When I first contacted the buyer on 10th Nov 2009 to advise the item had not arrived I received a nice response (see below)

Email Response 1****
Dear 915south,

yes it was sent international signed for 1st class airmail-the severity of the strike varies greatly throughout the

country-i'm sure it will be there soon
kind regards

- lolitashedevil

I waited some more time then asked some further questions like the international signed for tracking number in an email on 24th Nov and got this less helpful response

Email Response 2*****

Dear 915south,

IT WAS SENT AND IS AT YOUR SORTING OFFICE-PLEASE GO DOWN AND COLLECT IT

- lolitashedevil

When I responded again asking for a tracking number and date posted I got this even less helpful response

Email Response 3******

Dear 915south,

My brother works for royal mail and he has contacted Australia and they say they have it

- lolitashedevil

No option

Hmmm the responses are getting ridiculous now and guess what in my back and forth communicating with the seller I have missed both the deadline for claiming via paypal and ebay.

What can I do now but leave negative feedback which prompts a nasty reply in the feedback forum but its all I can do to warn people about this seller

Feedback

Item never arrived, to date no refund offered by seller, very unhelpful in email    Buyer: 915south( 178 [Feedback score is 100 to 499] )

Reply by lolitashedevil (27-Nov-09 09:27):
TRACKING PROVES DRESS ARRIVED IN AUSTRALIA AND WAS DELIVERED-HELPED ALL I COULD

 Follow-up by 915south (27-Nov-09 09:56):
SELLER WILL NOT PROVIDE TRACKING NO. AND HAS NOT REFUNDED LOST ITEM *BAD SELLER

The lesson

Always check the sellers feedback before making a bid - I've never really done this but now it has become a matter of importance because if I would have checked their feedback I would of noticed 16 negative and 8 neutral feedbacks in the past month.

Feeback on seller

I was also not aware that Royal Mail International signed post can only track an item as far as leaving the UK after that you are unable to track it. I only found this out on the Royal Mail website my seller lolitashedevil never gave me anything as useful as a tracking number - possibly because the item was never sent in the first place.

You can however as the sender make a claim for Royal Mail International signed postage if you have the tracking number - I learnt this from the Royal Mail website too. None of this is helpful to me as I seemed to luck out with a bad seller who does not want to help.

The Question

Why can't we have bad sellers followed up with ebay even after the 45 day limit? Even if we can't get a refund surely they can investigate a dodgy seller

Why if there was a UK postal strike and the feedback option on postage was removed for this period can't they extend the 45 day dispute limit. I waiting extended time before raising an issue due to this postal strike but now I've been burned.

What can I do now? I won't be getting a refund as the seller is now angry that I gave bad feedback - maybe I'll try and make a claim via my credit card. All I know is that I'm a wiser buyer now and I hope that this guide teaches someone else before they loose money.
