When is a new Nikon not new?

Recently purchased on eBay as new with warranty from Colcoligra, camera was indeed unused but cannot be warranted with Nikon as warranty only good for original purchaser, so beware when buying from this seller or any other seller, Nikon warranty only good when purchased from authorised reseller. Here is a recent email from Nikon to clarify. 

Dear Bill.
 Thank you for your email.
 
The Nikon Manufacturers warranty in non transferable from the original owner to another individual.
Unfortunately if you have purchased this camera from the original owner it is no longer covered by the warranty.

As you can see from the Nikon response items listed as new with warranty may well be new but cannot carry the warranty forward to the new purchaser. this leaves you with a clear dilemma, do you buy the camera and hope that it does not break down or do you purchase a private warranty from one of the many companies on the internet at extra cost to you not the seller or do you query the warranty statement with the seller and try to recover a partial refund to cover the private warranty.
My seller(Colcoligra) promised a partial refund of £50 to cover the problem but once case was closed with eBay he called back the payment, in retrospect I should have returned the camera.
