Please read these terms and conditions carefully before you place a bid. Your bid constitutes acceptance of these terms, upon which you enter into a legally binding contract. You must not bid without serious intention of paying.

Comic Relief registered charity 326568 (England/Wales); SC039730 (Scotland) is the seller of the auction items operating under the eBay seller name therealcomicrelief.

You must be 18 or over to place a bid for any item. Payment must be in GBP and received by Comic Relief through Paypal within 5 working days of the close of the auction. Alternatively, winning bidders can contact therealcomicrelief to arrange payment over the phone by credit/debit card. Failure to pay or contact Comic Relief within 5 days may mean the item will be offered to the next highest bidder.

Before you place a bid you must ensure that you are legally able to bid for and to buy that particular lot. It is the responsibility of all bidders to ensure that, should they be the winning bidder, they have the necessary permissions or authorisations to carry out the activity specified in the bid, including (by way of example, not limitation) appropriate identification, clean driving licence and minimum age qualification and so on.

Comic Relief will not be liable for any circumstances beyond its reasonable control including a bidder’s inability to access the auction on eBay due to technical difficulties or otherwise. To the extent permitted by law, Comic Relief does not accept any liability for any loss, damage, claim or costs howsoever arising from or incurred wholly or partly by participation in the auction (save for death or personal injury arising from negligence).

Comic Relief reserves the right to block a bidder for any reason including but not limited to, feedback, non-paying bidder, bid retractions, recent bid history or any breach of these terms.

Winning bidders cannot claim any cash or other alternative to the item they have won.

If you wish to give a lot as a gift, including if you intend the lot to be enjoyed by a minor who is not authorised to bid themselves, specific approval must be obtained from therealcomicrelief, in advance of bidding.

Comic Relief complies with the provisions of the Data Protection Act 1998 in processing personal information. As such, your personal information will be held confidentially by Comic Relief and will only be used by Comic Relief or disclosed to a third party if such use or disclosure is required for the purposes of the auction or as otherwise instructed by you.

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales, whose courts shall be courts of competent jurisdiction.

This prize is not open to employees of Comic Relief or the BBC.

Terms relating to meet and greet packages only

If you are the winning bidder of a meet and greet package you will be contacted by the celebrity (or the celebrity’s representative) within 10 working days or as soon as reasonably permissible, following full receipt of payment by Comic Relief. Comic Relief will not be directly involved in the fulfillment of meet and greet packages.

Unless specifically stated otherwise, the winner is responsible for all arrangements and costs required to take up the fulfillment of the item, including, but not limited to, travel and accommodation costs, general expenses including food and beverages, travel insurance and any other necessary documentation, including proof of age.

It shall be the responsibility of the winning bidder to come to agreement with the celebrity (or celebrity’s representative) for the fulfillment of their package. All the aspects of the fulfillment of the package are subject to such agreement being reached and to availability, and subject to the specific conditions specified.

If you are unable to reach agreement with the celebrity (or celebrity’s representative) regarding fulfillment then Comic Relief shall be entitled without challenge or complaint to award the item to the next highest bidder.

Comic Relief and the celebrity reserve the right to cancel the meet and greet package at any time should the winning bidder behave in an inappropriate or offensive manner.

Refunds

Refunds are at Comic Relief’s sole discretion and will be payable only where Comic Relief deems it reasonable, having regard for all the circumstances.
