General Terms and Conditions
Please read these terms and conditions carefully before you place a bid. Your bid constitutes acceptance of these terms, upon which you enter into a legally binding contract. You must not bid without serious intention of paying. Please only bid if you are 100% certain you can follow through with payment at the winning bid price promptly.
Cancer Research UK is a registered charity in England and Wales (1089464) and in Scotland (SC041666). The Bobby Moore Fund for Cancer Research UK is the seller of the auction items operating under the eBay seller name bobbymoorefund. All proceeds go to the Bobby Moore Fund. You must be 18 or over and a UK resident to place a bid for any item. Payment must be in GBP and received by the Bobby Moore Fund through Paypal within 48 hours of the close of the auction. Alternatively, winning bidders can contact bobbymoorefund through the eBay messaging system to arrange payment over the phone by credit/debit card. Failure to pay or contact the Bobby Moore Fund within 48 hours may mean the item will be offered to the next highest bidder.

Before you place a bid you must ensure that you are legally able to bid for and to buy that particular lot. It is the responsibility of all bidders to ensure that, should they be the winning bidder, they have the necessary permissions or authorisations to carry out the activity specified in the bid, including (by way of example, not limitation) appropriate identification and minimum age qualification and so on.
The Bobby Moore Fund will not be liable for any circumstances beyond its reasonable control including a bidder’s inability to access the auction on eBay due to technical difficulties or otherwise. To the extent permitted by law, the Bobby Moore Fund does not accept any liability for any loss, damage, claim or costs howsoever arising from or incurred wholly or partly by participation in the auction (save for death or personal injury arising from negligence).
The Bobby Moore Fund reserves the right to block a bidder for any reason including but not limited to, feedback, non-paying bidder, bid retractions, recent bid history or any breach of these terms.
Winning bidders cannot claim any cash or other alternative to the item they have won.
If you wish to give a lot as a gift, including if you intend the lot to be enjoyed by a minor, please be aware of any age restrictions listed on the item.
All items are sold as is. The Bobby Moore Fund will not be held responsible for discrepancies or inaccuracies in item descriptions provided, other than the warranties provided by the Seller. In the unlikely event of a product/experience being unavailable or other unforeseen events (e.g. illness, cancellation of event, death of the artist, war, civil emergency, imprisonment, natural disaster), the auction winner will be offered an alternative equivalent experience (not cash equivalent as these are ‘money can’t buy’ auction items) or product within three months or a mutually agreed time.
The Bobby Moore Fund complies with the provisions of the Data Protection Act 1998 in processing personal information. As such, your personal information will be held confidentially by the Bobby Moore Fund and will only be used by the Bobby Moore Fund or disclosed to a third party if such use or disclosure is required for the purposes of the auction or as otherwise instructed by you.
As part of our work to keep the auction secure, and ensure that you are bidding against genuine buyers, some high profile auctions may require bidder pre-approval. For this we require further personal details, which shall only be used for the purpose of the auction. Bidder personal information will not be published on any of the internet auction sites.
Terms relating to merchandise only
Within 7 working days of the Bobby Moore Fund receiving clear payment, items will be dispatched to the address specified by the winning bidder according to the postage service detailed in the item description or agreed directly with the Bobby Moore Fund, unless otherwise requested by the winner, except in circumstances beyond the control of the Bobby Moore Fund. Winning bidders must provide an address, phone number and signature for delivery. We cannot deliver to P.O.boxes.
Terms relating to meet and greet and experiential packages and holidays
If you are the winning bidder of a meet and greet, experiential package or a holiday, the Bobby Moore Fund will send you a letter informing you of the package you have won and will provide you with the relevant contact details. It is at this point, your responsibility to contact the Bobby Moore Fund or relevant bodies to arrange the experience or holiday.
Unless specifically stated otherwise, the winner is responsible for all arrangements and costs required to take up the fulfilment of the item, including, but not limited to, travel and accommodation costs, general expenses including food and beverages, travel insurance and any other necessary documentation, including proof of age.
It shall be the responsibility of the winning bidder to come to agreement with the Bobby Moore Fund, celebrity (or celebrity’s representative) for the fulfilment of their package. All the aspects of the fulfilment of the package are subject to such agreement being reached and to availability, and subject to the specific conditions specified.
If you are unable to reach agreement with the celebrity (or celebrity’s representative) regarding fulfilment then the Bobby Moore Fund shall be entitled without challenge or complaint to award the item to the next highest bidder.
The Bobby Moore Fund and the celebrity reserve the right to cancel the meet and greet and experiential packages at any time should the winning bidder behave in an inappropriate or offensive manner.
The winning bidder must be responsible for costs incurred to deliver all items, including those that may be heavy or bulky, such as framed items. It will be clearly indicated on all individual item listings to which this applies. Due to the fragile nature of these items, they must be delivered via courier or collected from the Bobby Moore Fund’s office in London by arrangement. The winning bidder can either arrange their own collection / courier service or the Bobby Moore Fund can invoice the winning bidder for an appropriate courier service once the delivery location has been confirmed. The Bobby Moore Fund will ensure that all items are packaged appropriately and securely, however cannot accept responsibility for any damage incurred in transit. There may be an additional surcharge for delivery to outlying areas, including (but not limited to) Scottish Highlands & Islands and Northern Ireland. The Bobby Moore Fund will always endeavour to find the most cost-effective courier service wherever possible. This will usually be for an overnight courier service, however a same day service can be arranged at the winning bidder’s additional expense if required.
Refunds are at the Bobby Moore Fund’s sole discretion and will be payable only where the Bobby Moore Fund deems it reasonable, having regard for all the circumstances.
If any provision in these terms and conditions shall be prohibited by or adjudged by a Court to be unlawful void or unenforceable such provision shall to the extent required be severed from these terms and conditions and rendered ineffective as far as possible without modifying the remaining provisions and shall not in any way affect any other circumstances or the validity or enforcement of these terms and conditions.
Third Party Rights
These terms and conditions do not create or confer any right under the Contracts (Rights of Third Parties) Act 1999 which are enforceable by any person who is not a party to these terms and conditions.
All bidders agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or in relation to the auction or these terms and conditions must be filed within one (1) year after such claim or cause of action arises or be forever barred.
These terms and conditions shall be governed by and construed in accordance with the laws of England, whose courts shall be courts of exclusive competent jurisdiction.
