Please read these terms and conditions carefully, as they contain important information about your rights and obligations in respect of any item purchased through eBay, as well as limitations to warranty and liability that may apply to you (‘the Customer’)
1. Parties and Definitions
Panasonic UK, a branch of Panasonic Marketing Europe GmbH is a seller of products and/or services.
Panasonic UK, a branch of Panasonic Marketing Europe GmbH is a branch registered in England and Wales with branch number BR015033, having its registered office Panasonic House, Willoughby Road, Bracknell, Berkshire, RG12 8FP (hereafter referred to as ‘Panasonic’).

For the purposes of these terms and conditions;
Panasonic shall mean Panasonic Corporation and any associated legal entity, subsidiary or company in which Panasonic Corporation directly or indirectly has ownership of at least 50%.
Customer or you shall mean the person (or legal entity) who buys products or services via the Panasonic shop on eBay and whose order is accepted by Panasonic.
Contract shall mean the contract containing these terms, which have been produced in accordance with the general terms and conditions of eBay (in respect of the eBay.co.uk)
Invoice shall mean the invoice sent to you for the payment due price of any product or service
Order shall mean any order placed by you, in accordance with these terms and conditions.
Products shall mean any products offered for sale in the Panasonic shop website at eBay.co.uk
Services shall mean any service offered by Panasonic in the Panasonic shop website at eBay.co.uk in exchange for payment or free of charge (for example delivery or packaging services).
Terms shall mean these terms and conditions
Panasonic shop shall mean the online Panasonic shop, which Panasonic operates on the English language eBay website, selling Panasonic products.
2. Scope of the Terms and Conditions
The purchase of any products or services by you, the Customer shall be governed by these terms and conditions, which shall supersede all other terms. Products or services purchased through the Panasonic shop on the English language eBay website, eBay.co.uk and are also subject to the applicable eBay terms and conditions.
3. Price and postage
Whilst Panasonic try to ensure that all prices in the online Panasonic shop are accurate, errors may occur. If an error is discovered in the price of a product or services ordered, Panasonic reserve the right to cancel the order and invite you to place another order for the goods at the correct price. In this event, Panasonic shall contact you. If Panasonic cannot contact you, your order will be deemed cancelled. If Panasonic should cancel an order where payment has already been made, a full refund shall be made.
All Panasonic shop products shall be inclusive of VAT.
4. Payment Terms
The invoice and shipping addresses must be in the same country.
Panasonic shall accept payment by PayPal from verified PayPal users only. Other payment methods shall not be accepted and any associated orders shall be immediately cancelled, where items have been ordered for delivery. Purchase must be completed within five (5) days. If payment is not made within five (5) days items may be relisted for sale to another customer.
Customers collecting items from store may pay for their items upon collection, in person, with a credit/debit card using chip & pin or cash. Collection must be made within five (5) days. If collection is not made within five (5) days your items may be relisted for sale to another customer.
Panasonic cannot guarantee full availability of any product. Where a product is unavailable, you may be offered a similar product. Once payment has been made an order cannot be cancelled.
5. Delivery
Products are delivered and services supplied within the United Kingdom only. Any items collected from our store must be paid in person with a credit/debit card using chip & pin or cash.
The carriage and transportation of products shall be determined at Panasonic’s discretion. Where multiple products have been ordered and are unavailable at the same time, Panasonic reserve the right to deliver should products/services separately, where reasonable.
Delivery information on the eBay.co.uk product/item page shall also apply and should be read.
6. Delivery Date
Panasonic shall endeavour to make prompt delivery, in line with estimated delivery dates. However, circumstances may arise beyond Panasonic’s control that may make it impossible to meet a specific delivery date. As such, all delivery dates are given as an estimate only. Panasonic shall only be required to refund the Customer where a specific delivery date has been offered and has not been met.
Should Panasonic be unable to deliver the products or provide the services purchased by the agreed or estimated delivery date, Panasonic shall reserve the right to cancel the order and offer a refund to the customer. Unless as a result of gross negligence or intentional damage by Panasonic, Panasonic shall not be held liable for loss or damage caused by the delay.
7. Returns
Products may be returned for any reason, other than physical or accidental damage, for a complete refund of the actual purchase price within 30 days of receipt of the product, in accordance with the Consumer Protection (Distance Selling) Regulations 2000 and subject to the following pre-conditions:
- You must request a return number from Panasonic by either calling 0300 3300 970 or contacting us through the eBay messaging system.
- The return number and return address must be clearly attached to the outside of the parcel in which the products are returned to Panasonic.;
- The products must be returned in their original packaging and in brand new condition along with all components, products, parts and accessories, warranty cards, instruction manuals and other documents and materials.
Should a product be received in a broken or defective condition, please contact us by either calling 0300 3300 970 or emailing us through the eBay messaging system stating the order number, product purchased, date of purchase and reason for return.
The following issues must be reported to us within 48 hours of receipt;
1) Missing items or accessories
2) Damaged or lost items
3) Incorrect items received
After the products have been returned, Panasonic shall refund (less any necessary deductions) the actual amount paid to Panasonic to your PayPal account (or other means of payment).
If an order has been incorrectly ordered or is unwanted, you must pay for the return cost yourself, unless you received the wrong products/services. The return address and further instructions on how to return the products can be found on the return slip included with your delivery.
Nothing in these terms and conditions shall affect the terms of manufacturers’ warranties and guarantees or your legal rights in relation to Goods that are faulty or not as described. Advice about your legal rights is available from your local Citizens Advice Bureau or Trading Standards office.
8. Exceptions to Returns
You shall have no right to return products or services if you have not purchased them as a user. (A user is a natural person who, in making a contract, is acting for purposes which are outside his trade, business or profession)
Software which is sold along with Panasonic products or as a separate product may not be returned for a refund if the seal on the software is broken.
Software licences
All software, including software which has been pre-installed in the hardware, is licensed for use, not sold. The software shall be licensed for use either by Panasonic or the owner of the software under the end user licence agreement or other terms and conditions included with the software and/or product or service. The software may not be disassembled, decompiled, reverse-engineered, merged or combined with other software, copied, decoded, adapted, modified or altered (unless expressly permitted by prevailing law) or distributed in any manner whatsoever.
If no express software licence terms and conditions have been provided, you shall be granted a non-exclusive and non-transferable single user software licence for use with the accompanying product only.
If you do not accept the terms and conditions of the software licence, you must return the product – except in the cases set out in clause 8 – unused and 'like new' in accordance with clause 8 and within the period indicated therein. Please note: The purchase price cannot be refunded if the seal on the software has been broken (see clause 8)
9. Manufacturer and statutory warranty
Panasonic warranty
Subject to the restrictions on statutory claims, Panasonic does not give any warranties on products or services in addition to those stated on the warranty cards included with the products or – in the event of a voluntary warranty extension from Panasonic or a Panasonic group company – in addition to such a warranty extension ('warranties').
Warranty cards (Where applicable)
Warranty cards included with the products, contain certain product representations and warranties by Panasonic or the relevant Panasonic group company. More detailed information can be found on the warranty card.
If no warranty card has been included with the product or in the event of a defect owing to circumstances not covered by the warranty, Panasonic shall only be held responsible for repairs falling under the statutory warranty according to the applicable law and in compliance with the limitations in these terms and conditions.
10. Limitation of liability
All obligations and liabilities arising from the delivery or non-delivery of products and services for Panasonic and Panasonic group companies are set out in these terms and conditions.
Panasonic and Panasonic group companies shall not be liable to you (or any other party):
- for indirect and consequential damages, for penalties and damages for other expenses, lost income, lost profits, business, money and contracts or for losses in relation to goodwill, licences, time, data and electronically transmitted orders or for other financial disadvantages unless such damage is caused intentionally by Panasonic or arises from its gross negligence or such damage arises from fatal, personal or health injuries. Liability under the Product Liability Act shall not be affected;
- for any inability to order products or services via the Panasonic shop on eBay.co.uk or in any other manner that you should experience;
- damage or losses caused by the unauthorised use of your eBay account (user name).
11. Data protection
Use of personal information
By placing an order, you agree that your personal information, e.g. name and title, address, telephone number and any other personal details ('personal information') may be used and processed where required to complete this contract and that Panasonic may contact you to understand your buying experience and may offer you Panasonic services and products associated with your Product purchase from time to time. Please note that you may opt out from receiving any future communication by clicking on the link provided in any future communication.
Your information shall be treated in accordance with our Privacy Policy (http://www.panasonic.com/uk/privacy-policy.html), which may be viewed by clicking the link. Under certain circumstances, Panasonic may require additional personal information in order to verify your identity and prevent fraud. Such information shall also be construed as your 'personal information'.
Panasonic reserves the right to share your personal information with, place it at the disposal of or transfer it to other departments and divisions of Panasonic (as defined in Clause 1 of these terms and conditions).
Disclosure of information
Panasonic shall never disclose your personal information without your consent to other companies or persons ('third parties') than Panasonic group companies except in the following instances:
Personal information may be disclosed to third parties if it is required to complete a contract to which you are a party, or for other stated purposes.
12. Export Control
You shall acknowledge that products, which are sold to you or for which you receive a licence in accordance with these terms and conditions, may be subject to the export control laws and regulations of various jurisdictions, e.g. particularly countries of the European Economic Area. You shall confirm that, in such cases, you shall refrain from exporting or re-exporting the products in violation of such laws and regulations.
13. Governing law and jurisdiction
The sale of products and/or services as well as these terms and conditions shall be governed by and construed under the laws of England and Wales without prejudice to the user rights granted by these terms and conditions. The Court of England and Wales shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these terms and conditions.
14. Other
Circumstances beyond our control, force majeure
In the event that a contractual partner is prevented from fulfilling the contract by circumstances or events beyond its control or which it cannot economically be expected to avert, e.g. in the event of war, strikes, lockout, disruptions in the supply of energy, fire, acts of sovereign powers or other acts of nature, its obligations under this contract shall be suspended. The contractual partners shall endeavour to remedy any disturbances or disruptions forthwith.
Severability
If any of these terms and conditions shall be deemed to be entirely or partially illegal, invalid, unenforceable or prohibited under a prevailing law or regulation for any reason or if they are found to be entirely or partially illegal or unenforceable under a prevailing law or regulation of a jurisdiction or a country or in relation to a certain category of people, these terms and conditions shall be read as if the illegal, invalid or unenforceable words or provisions had to that extent been deleted and the legality, validity and enforceability of the remaining provisions or parts thereof (in relation to this jurisdiction, country or category of people) shall not be affected in any way whatsoever. The legality, validity, and enforceability of such provisions under the prevailing laws of any other jurisdiction, country or category of people shall not be affected in any way whatsoever.
