1. Scope of validity
The following terms and conditions of business apply for all orders placed through our eBay Shop.

2. Contract partner; Conclusion of the contract 
The contract of purchase is formed with momox GmbH.

Auction format
If we post an article in an auction or fixed price format, we thereby make a binding offer to conclude a contract for this article. In this respect, we determine the start or the fixed price and the bidding period, that is to say, the period during which the offer can be accepted. If, in the case of an auction format, we stipulate a minimum price, the offer is subject to the condition precedent that the minimum price is achieved. Fixed price format
Where we post articles in a fixed price format, we are making a binding offer for the conclusion of a contract for this article. You accept the offer by clicking the button "Buy now" and subsequently confirming the purchase. In the case of fixed price articles where we have selected the option "Immediate payment", you accept the offer by clicking the button "Buy now" and completing the payment process immediately following. Option price proposal 
If in any of our offers the button "Send price proposal" is displayed under the Buy now price, you can suggest a price to us at which you would buy the article. 3. Payment
In our shop, you can choose from the following methods of payment:

Advance payment
Where you select the method of payment "Advance payment" we give you details of our bank account in the confirmation of the order and deliver the goods following receipt of payment.

Paypal
You pay the invoice amount via the online provider Paypal. As a basic principle, you need to be registered there or need first to register in order to legitimise yourself with your access data and to confirm the payment instructions to us. You will receive further details during the order process.

4. Reservation of title 
The goods remain our property until payment has been made in full.

5. Transport damage 
If the goods are delivered with evident transport damage, please lodge a complaint with the delivery agent as soon as possible and contact us immediately. Failure to lodge a complaint or to contact us does not have any effect on your statutory rights or enforcement of the same, in particular of your warranty rights. However, you will assist us in asserting our own claims against the carrier or transport insurance company.

6. Warranty and guarantees
Except as expressly provided to the contrary below, the statutory provisions concerning warranties apply.
In the case of second-hand goods, the limitation period for warranty claims amounts to one year as from the delivery of the goods.
The above-mentioned restrictions and reductions in time limits do not apply for claims by reason of any damage caused by us, our statutory representatives or vicarious agents
- in the case of injury to life, limb or health
- in the case of any deliberate or grossly negligent breach of duty or fraudulent intent 
- in the case of any breach of fundamental contractual duties, the fulfilment of which makes the proper execution of the contract possible in the first place and on compliance with which the contract partner is regularly entitled to rely (cardinal obligations)
- within the scope of a guarantee commitment, in so far as agreed 
- within the scope of the area of application of the Produkthaftungsgesetz [Product Liability Act].
