Terms & Conditions
These terms and conditions set out the basis on which you can visit and use our eBay shop. Please read them carefully as they contain important information.
1.1 In these Terms, unless the context requires otherwise:
"MW" means modellweltde on www.ebay.co.uk
"Contract" means each contract for the supply of Goods by us into which these Terms shall be incorporated
"Goods" means the goods which we supply in accordance with these Terms
"Order" means a purchase order in respect of the Goods issued by you to us
1.2 The eBay shop modellweltde is operated by modellweltde, registered at – Big Yellow Storage, 39a Robjohns Road, Widford Industrial Estate, Chelmsford, Essex, CM1 3AG.
1.3 MW reserves the right to change these Terms from time to time. Any such changes will take effect when posted on the eBay shop and it is your responsibility to read the terms and conditions on each occasion you use this eBay shop and your continued use of the eBay shop shall signify your acceptance to be bound by the latest Terms.
1.4 There may be legal notices on other areas of this eBay shop which relate to your use of this eBay shop, such as our Delivery Policy and our Returns Policy, all of which will, together with these Terms govern your use of this eBay shop.
2. Order Process
2.1 Please note that the colours of the Goods are as accurate as the eBay shop allows, as the actual colours you see will depend on your monitor. We cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.
3. Acknowledgement & acceptance of your order
3.1 If you have supplied us with an email address, we will send you a confirmation email as receipt of your Order. You will then be sent another email on despatch of your Goods. All Orders will be subject to our acceptance in accordance with these Terms. Our acceptance of your Order will take place when we dispatch the product/s to you.
3.2 MW has taken every care in the preparation of the content of this eBay shop, and in particular to ensure that (i) prices quoted are correct at time of publishing; and (ii) the Goods have been fairly described. However, please note that we may only accept Orders if there are no material errors in the description of the Goods or their prices as advertised on this eBay shop. Non-acceptance of an order may be as a result of the identification of a pricing or product description error as referred to in this condition.
3.3 All of the products for sale at MW are subject to availability. If we experience problems with availability and are unable to supply your goods, we will send an email informing you of this as soon as possible. Where the goods have already been paid for, a refund will be issued.
4.1 Subject to condition 5 (Delivery charges), the prices stated by us at the time we receive your Order are the prices you pay except where we discover an error in the price of the Goods you have ordered. In this event, we will inform you as soon as possible after receiving your Order and will cancel the sale. If we are unable to contact you we will treat the Order as cancelled.
4.2 All prices are displayed on the eBay shop in pounds sterling and are inclusive of VAT where relevant at the prevailing rate charged in the UK.
4.3 Prices that are reduced for sales and promotions are only valid for the specified period. We reserve the right to adjust prices, offers, goods and specifications of goods on the eBay shop at our discretion at any time before (but not after) we accept your order.
5. Delivery we offer FREE DELIVERY on most MW purchases within the UK.
If we experience unexpected problems with availability and are unable to deliver your order within 5 working days, our Customer Service Team will send an email informing you of this.
All of our items are subject to stock availability. Please be aware that we cannot accept liability for any expenses incurred because of delayed or unsuccessful deliveries. We will always endeavour to get your purchase/s to you within the delivery timescale specified, however, we cannot guarantee that deliveries will be made within this period, nor accept liability for deliveries that are made outside of it.

6. Tracking your order FAQs
Where do you deliver to?
We are able to deliver your Goods to any address within the UK mainland (including the Highlands of Scotland). We also deliver to the Scottish Islands, Northern Ireland, Isle of Man and Isles of Scilly although deliveries to all these locations may take longer than the timescales.

How do I pay?
We only accept payment via PayPal, which is the quickest, easiest and most secure way to pay. We’re sorry but we are unable to accept cheques, postal orders, credit cards, bank transfers. Can I track my parcel?
Once your Goods have been dispatched you will receive an e-mail confirming that they are on their way and a link to the courier to allow you to track your order. Our carriers deliver Monday to Friday between the hours of 8.30am to 9.00pm; Please e-mail us at: email@example.com with your order number if you have not received your parcel within 5 working days.
Will my parcel require a signature on delivery?
If your parcel is being delivered by courier then someone at the delivery address must be available to sign on receipt of the goods. If you are out then you will receive a calling card including contact details to re-arrange an alternative delivery time.
What happens if I am out when you deliver?
You will receive a calling card inviting you to collect your order from the local sorting office. If our courier has attempted a delivery they will also leave a card including contact details to re-arrange an alternative delivery time.
What happens if the item I have ordered is out of stock?
In the very rare event that we are unable to supply an item you have paid for, we will contact you by e-mail to cancel the order and provide a full refund immediately via PayPal.
When will I receive my refund?
We aim to refund items as soon as they are received back into our returns centre. Please contact us by e-mail at: firstname.lastname@example.org if you are concerned that you have not received your refund.
What happens if I receive a damaged item?
It is always recommended that you examine your product/s on arrival and contact us within 7 days if an item is damaged. Please e-mail us at: email@example.com should you have the misfortune to receive damaged goods.
Refunds will not be made if parts are missing or promised to be returned, only when all parts are present and correct will a refund be issued.
Refunds for perfectly returned complete products will be issued within 3 working days of the products return.
What happens if I receive the wrong item?
If you receive the wrong item please let us know immediately by e-mailing us at: firstname.lastname@example.org We will arrange to collect the incorrect item free of charge, and send a replacement (subject to availability). If the item is no longer available then you will be given a full refund along with our sincere apologies for the inconvenience.
How do I return my item?
We recommend that you use Royal Mail registered post with insurance to the value of the goods purchased or Parcel force with insurance to the value of the goods purchased, as we cannot accept responsibility for lost parcels.
Items returned must be in the same condition as dispatched by us, all products are photographed before leaving us and the products must be returned as we sent them with no parts missing or broken.
All returns must be insured by the sender to the correct value of sale.
MW accept no responsibility for products returned which are broken or lost in transit with no insurance. Broken goods returned to MW even with insurance the liability belongs to the sender and MW accepts no liability for these issues, this is down to the sender to claim for the broken product from the sending agent.

7.1 If you have received a damaged or faulty item, then please contact our customer service team on email@example.com within 7 days.
7.2 Under the distance selling regulations you have the legal right to cancel your order within seven working days of receipt of the goods (with the exception of purchases of perishable items such as food; items such as swimwear that, by reason of their nature, cannot be returned; and special orders).
8. Warranties and Liability
8.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence or fraudulent misrepresentation.
8.2 In the absence of any negligence other than breach of duty by MW, your use of any Goods other than in accordance with their operating manuals and/or instructions is entirely at your own risk.
8.3 MW will make every effort to deliver Goods within a reasonable time from the date of your Order and to comply with our obligations under these Terms, but we cannot be held responsible for delays or failures due to adverse weather, traffic delays, mechanical breakdowns or other circumstances beyond our control.
8.4 The information contained in the material in this eBay shop is only for information purposes. MW, by permitting the use of this eBay shop, does not hold itself out as providing any legal, financial or other advice. It also does not make any recommendation or endorsement as to any investment, advisor or other service or product or to any material submitted by third parties or linked to this eBay shop. 8.7 If either you or we are in breach of the arrangements under these Terms, neither of us will be responsible for any losses that the other suffers as a result, except those losses which are a foreseeable consequence of the breach. Losses are foreseeable where they could be contemplated by both you and us at the time you place an Order.

13. Business Use
We have selected our Goods on the basis that they will be used for domestic use only, if you are planning to use them for business purposes please make sure that you are covered by the appropriate insurance. Where you decide to use the Goods in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the products shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud).
