1. Scope of validity
The following terms and conditions of business apply for all orders placed through our eBay Shop.

2. Contract partner; Conclusion of the contract 
The contract of purchase is formed with momox GmbH.

Auction format
If we post an article in an auction or fixed price format, we thereby make a binding offer to conclude a contract for this article. In this respect, we determine the start or the fixed price and the bidding period, that is to say, the period during which the offer can be accepted. If, in the case of an auction format, we stipulate a minimum price, the offer is subject to the condition precedent that the minimum price is achieved. We may additionally equip offers in an auction format with a "Buy now function" which you can activate as long as no bid has been made for the article or the minimum price has not yet been reached.
In the case of auctions, you accept the offer through making a bid. Acceptance is subject to the condition precedent that you are the highest bidder following the expiration of the bidding period. Your bid lapses if another buyer submits a higher bid during the bidding period.

Fixed price format
Where we post articles in a fixed price format, we are making a binding offer for the conclusion of a contract for this article. You accept the offer by clicking the button "Buy now" and subsequently confirming the purchase. In the case of fixed price articles where we have selected the option "Immediate payment", you accept the offer by clicking the button "Buy now" and completing the payment process immediately following. You can also accept offers for several articles by placing the articles (in so far as available) in the shopping basket and completing the payment process immediately following.

Option price proposal 
If in any of our offers the button "Send price proposal" is displayed under the Buy now price, you can suggest a price to us at which you would buy the article. We may accept or reject your price proposal or submit a counter offer. If you submit a price proposal to us, you are making a binding offer to conclude a contract for this article at the price proposed by you. Your price proposal is valid for 48 hours or up until the end of the offer, whichever point in time is reached first. If we accept it, a binding contract is formed. We make delivery only by despatch. We regret that customers are unable to collect the goods themselves.

3. Payment
In our shop, you can choose from the following methods of payment:

Advance payment
Where you select the method of payment "Advance payment" we give you details of our bank account in the confirmation of the order and deliver the goods following receipt of payment.

Paypal
You pay the invoice amount via the online provider Paypal. As a basic principle, you need to be registered there or need first to register in order to legitimise yourself with your access data and to confirm the payment instructions to us. You will receive further details during the order process.

4. Reservation of title 
The goods remain our property until payment has been made in full.

5. Transport damage 
If the goods are delivered with evident transport damage, please lodge a complaint with the delivery agent as soon as possible and contact us immediately. Failure to lodge a complaint or to contact us does not have any effect on your statutory rights or enforcement of the same, in particular of your warranty rights. However, you will assist us in asserting our own claims against the carrier or transport insurance company.

6. Warranty and guarantees
Except as expressly provided to the contrary below, the statutory provisions concerning warranties apply.
In the case of second-hand goods, the limitation period for warranty claims amounts to one year as from the delivery of the goods.
The above-mentioned restrictions and reductions in time limits do not apply for claims by reason of any damage caused by us, our statutory representatives or vicarious agents
- in the case of injury to life, limb or health
- in the case of any deliberate or grossly negligent breach of duty or fraudulent intent 
- in the case of any breach of fundamental contractual duties, the fulfilment of which makes the proper execution of the contract possible in the first place and on compliance with which the contract partner is regularly entitled to rely (cardinal obligations)
- within the scope of a guarantee commitment, in so far as agreed 
- within the scope of the area of application of the Produkthaftungsgesetz [Product Liability Act].

7. Youth protection
Where your order comprises goods, the sale of which is subject to age restrictions, we ensure through the use of a reliable process, including a personal identity and age check, that the person placing the order has reached the necessary minimum age. The delivery agent will only hand over the goods following an age check and only personally to the purchaser.

Consumers have a one-month right of cancellation.

In order to comply with the cancellation period, it is sufficient if you send the notification of exercise of your right of cancellation before the cancellation period expires.

Consequences of cancellation
If you cancel this contract, we have to refund all payments which we have received from you, including the delivery costs (with the exception of any additional costs arising through your having selected a mode of delivery different from the cheapest standard delivery offered by us). The refund will be made promptly and at the latest within fourteen days from the date on which we receive the notification of your cancellation of this contract. For this refund, we will use the same means of payment as you used in the original transaction unless otherwise expressly agreed with you; in no case will you be charged any fee in connection with this refund. We may refuse to make the refund until we have received the goods back again or until you have produced proof that you have sent back the goods, whichever is the earlier point in time.

You comply with this deadline provided you send the goods back before the fourteen-day period has expired. You bear the direct costs of returning the goods. You only have to pay for any diminished value of the goods if this diminished value results from handling the goods in a manner other than was necessary to examine their quality, features and functioning.
