Formerly illegal to use, FM transmitters were legalised in December 2006 -- subject to certain conditions, the main one of which is that the transmitter must be certified by bearing the CE mark.

If your seller does not mention "CE certified" in the listing, it would be wise to ASQ to verify before bidding on your item. Transmitters not bearing the CE mark may not comply, and are in any case still not legal to use.

However, Ebay has not yet updated its own rules at http://pages.ebay.co.uk/help/policies/electronics.html and for the moment it might be unwise for UK sellers to list such items without getting clarification from ebay on their policy resulting from this recent change in the law.
