Terms and Conditions of Sale
1. This document contains all the terms and conditions of the agreement between the buyer and the seller. The seller reserves the right to vary any term or condition by giving written notice to the buyer.
2. Unless otherwise agreed in writing between the buyer and the seller, these conditions shall apply to all contracts to the exclusion of all other terms and conditions including any terms and conditions which the buyer may purport to apply under any buyer specification, purchase order or similar document.
2.2 These Conditions shall also apply to any future oral or written Contract save to the extent that the subject matter herein is in conflict with any written agreement signed by the Seller and governing the Contract, where on the provisions of such written agreement shall prevail.
2.3 No verbal representation or verbal statement by an employee or agent of the Seller shall form part of the Contract nor shall any such verbal representation or statement be treated as constituting a representation on the part of the Seller or a term of the Contract unless such representation or statement shall be confirmed in writing.
• Costs shall be described in full within the invoice for the sale of the goods referred to within that or subsequent invoice but can be subject to change due to unforeseen increases. Additional items requested but not initially agreed at time of purchase may be invoiced separately and incur additional shipping charges.
• Adapting parts or changing specific parts to customer specification may incur additional labour, supply and shipping costs to be added to final invoice or revised invoice without notice.
• Delivery shall be booked for collection by courier within a timeframe available to given workload and may be subject to delay at busy periods such as summer or Christmas. The buyer will be notified in writing of expected collection and delivery dates and any delays thereof.
• Whilst the seller shall attempt to make delivery within the timescale agreed, delivery times remain the responsibility of the courier once goods are in transit.
• Goods shall remain the sole property of the seller until paid for in full.
• Payment terms. Payment shall be made in full within seven days of invoice receipt by the payment method requested in the invoice.
• Credit only available on hire equipment subject to hire terms available separately.
• The Seller reserves the right to charge interest on late payments and claim compensation for debt recovery costs.
• The buyer may return the goods for refund within seven days of receipt for
Wrong item sent : return the item for full refund including shipping
Faulty Goods: return the item for repair or replacement or full refund (Excludes transit damage.)
Change of mind: The buyer may return the goods for refund excluding shipping within a timescale agreed with the seller. The seller reserves the right to inspect the goods and refuse refund where insufficient packaging has been used and transit damage has occurred as a result or where parts have been removed or modified by the buyer before return. All serial numbers where applicable are recorded and where substitute or modified items have been returned the seller shall refuse refund and claim compensation for the goods or debt recovery costs incurred.
The buyer in all cases is responsible for the safe return of the goods with no exceptions.
The buyer shall bear the return costs in all cases.
The buyer shall return the goods via a courier specifically provided by the seller. Any other shipping method shall be deemed as breach of these terms and may result in a voidance of refund.
• The seller shall supply goods as designed and for the use as designed but reserves the right to substitute goods or parts with other goods or parts of similar specification new or refurbished provided that said goods are fit for purpose and use.
• The seller shall not be liable for loss of income resulting from delayed transit or from equipment fault.
• The seller shall not be liable for damage caused to or from beer dispense equipment, cleaning systems or injury sustained either by user or third party.
• The seller shall not be liable for any injuries sustained by the user or third party where the goods have not been used as designed have been misused or adapted for other use.
These terms and conditions are a provision of sale between the buyer and the seller under English Law and by entering into the Contract the parties submit to
the exclusive jurisdiction of the English Court
WARRANTY.
Unless specified there is no warranty offered or implied.
Warranty specified on new goods will be no more than 12 months from receipt provided goods have been used as designed and excludes wear and tear or misuse.
Warranty specified on refurbished goods shall be offered at the discretion of the seller and last no more than 3 months from receipt of delivery provided goods have been used as designed and excludes wear and tear or misuse.
Goods may be returned under warranty by the buyer to the address shown on the invoice at the buyers cost via a courier specified by the seller, failure to use the specified courier and any transit damage incurred may result in breach of contract by the buyer and void any refunds or replacements due.
Goods shall be repaired or replaced within a reasonable timeframe subject to sourcing of replacement goods or parts and returned to the buyer free of charge within the warranty period.
The seller reserves the right to replace goods with a different model of similar or same spec where replacement is required and model is not available, The buyer shall be notified in writing of such change.
