Extended Producer Responsibility selling in Spain

Extended Producer Responsibility (EPR) is a broad collection of EU directives and regulations around producer responsibility for waste management. If you’re an international business seller, based outside Spain but offering to sell to buyers in Spain, you must comply with EPR rules around environmental legislation, which includes rules for invoices, receipts and sales documentation.

As a global marketplace, eBay has an obligation to ensure that our foreign business sellers are compliant with certain EPR regulations, including the Spanish Royal Decree 1055/2022. The Royal Decree 1055/2022

If you’re an international business seller who is offering to sell to buyers in Spain from abroad, you need to make sure you’re compliant with the Royal Decree 1055/2022. Under this regulation, you may be considered a Producer of Products with responsibility for the shipping packaging materials.

For example:

  • You are shipping goods to Spain from the United States, or another foreign country
  • You live in in Spain and ship goods to Spain from a warehouse in Italy, or another foreign country

How to comply on eBay

To comply with this legislation, you need to add a Spanish Producer of Products Registration Number to your invoice. To help you with this, eBay has registered with the authorities to obtain a Spanish Producer of Products Registration Number that can be used by all international business sellers offering to sell in Spain.

International business sellers will need to add eBay's Producer of Products Registration Number to invoices for goods shipped to Spain as follows:

  • "Spanish Producer of Products Registration Number: ENV/2023/000034242"

This can be added anywhere on the invoice.

If you already have your own unique Producer of Products Registration Number independent of eBay, please continue to use it on your invoices for goods shipped to Spain.

eBay and ECOEMBES

In order to comply with EPR regulations in Spain as an e-commerce platform, eBay has registered as a Producer of Products with ECOEMBES and will declare all products that are imported into Spain from international business sellers through ECOEMBES. ECOEMBES is the Spanish non-profit organization that coordinates the recycling of light household packaging in Spain, and acts as the Collective Scheme for RAP (SCRAP) for business sellers. eBay will fulfill all other requirements associated with this Royal Decree on behalf of international business sellers shipping goods to Spain, including:

  • Becoming part of a SCRAP, such as ECOEMBES
  • Settling related fees, such as the economic contributions to a SCRAP
  • Reporting the annual packaging volume put into circulation in the market

Sales packaging covered by the Royal Decree 1055/2022

The Royal Decree 1055/2022 covers all sales packaging that could be used, consumed, or bought in a shop by an individual, regardless of where the sales packaging is bought or used.
