Beta and OEM software policy

OEM (original equipment manufacturer) software can be sold with the original hardware but must not be sold separately. Beta software can’t be sold on eBay.

To ensure only authorised goods are listed on eBay, and to prevent the infringement of intellectual property rights, there are restrictions on the type of software that can be sold on eBay.

What is the policy?

  • Beta software including beta keys, cards or access codes are not allowed
  • OEM, bundled or recovery software listed on the site must follow these rules:
    • The listing must include the original hardware, such as the motherboard or hard drive
    • Utility software must include the peripheral device, such as a printer

Activity on eBay is required to follow this policy, the eBay User Agreement and all applicable laws, as well as respect the rights of third parties. If it doesn’t, eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: Removing the listing or other content, issuing a warning, restricting activity or account suspension.
