la vendita in questione e' soggetta al D.Lgs n. 50 del 15/01/1992 e dalle successive modifiche apportate dall’art. 5 del Decreto Legislativo n. 185 del 22/05/99 che prevede la possibilità da parte dell'acquirente di esercitare il diritto di recesso.

Il diritto di recesso si applica alle persone fisiche (consumatori) che agiscono per scopi che possono considerarsi estranei alla propria attivita' commerciale.

Sono perciò esclusi dal diritto di recesso, gli acquisti effettuati da rivenditori e da aziende.

Il consumatore ha diritto, entro un termine di 10 giorni dal ricevimento della merce, di esercitare il diritto di recesso. Tale diritto consiste nella facoltà di restituzione del bene acquistato al venditore1, e nel conseguente rimborso relativo al prezzo di acquisto, intendendo come tale l’importo netto corrisposto per il bene escluse spese aggiuntive quali imballo, manodopera, trasporto, tasse di contrassegno. Il consumatore dovrà altresì restituire al negozio in questione1 presso l’indirizzo da questo dichiarato, i Prodotti integri e nel loro imballo originale, entro dieci giorni dalla data di ricevimento degli stessi unitamente a DDT, Fattura o scontrino fiscale. Le spese di spedizione saranno a carico del consumatore. Entro 30 giorni dalla data di ricevimento della comunicazione del recesso ovvero dalla data di ricevimento dei prodotti restituiti, il negozio in questione rimborserà al consumatore le somme già pagate ad esclusione delle spese accessorie (imballo, manodopera, trasporto, tasse di contrassegno). Nel caso in cui il Contratto abbia per oggetto la fornitura di Servizi, il diritto di recesso non può essere esercitato nei confronti delle prestazioni già eseguite.
