Terms & conditions
Toolsrus operates under trade only terms and conditions as business to business including sole traders & local authorities. No other warranties either expressed or implied by law are made with respect to these goods.
Contract:
You confirm that you are purchasing the goods in your basket and that you will pay for these goods in full. If you have selected an offline order you confirm that it is your intention to purchase these goods and that you will dispatch payment without delay. Our terms and conditions may change at any time and you accept that it is your responsibility to check these prior to making a purchase.
Product Descriptions & Specifications:
All product specifications on this site are provided "as is". Manufacturers are entitled to change product specifications without notice. Industrial Supplies Direct (Telford) Ltd are not responsible for such changes, nor shall we be held responsible for any errors or omissions resulting from incorrect specification information. You should confirm that the product you are ordering has the specification you require and we cannot issue refunds or compensate for purchases made in error or because a product does not provide features/specification which you require or because the image on this or any site varies from the appearance of the product you purchase. Whilst we try to be as descriptive and as helpful as we can when describing an item over the phone, any decision to purchase is your own, if an item is ordered and is not what you expected or is not the quality that you expected, you will still be liable to pay any necessary carriage charges should you wish to return the item, despite what any member of our sales team may have said to you on the phone. Where any questions with regards to the quality of an item are asked will be answered taking the price of the item into account . It is advised that you make your own decisions on quality before ordering as quality is subject to opinion.
Delivery Times:
All delivery times on this website are an estimate and do not take into account any possible delays. Please note that as neither tool manufacturers or couriers operate on a weekend the term "days" in our delivery times applies to working days only (mon-fri). This applies to next day delivery. For example if an item was ordered on a Friday for 24hr delivery, it should arrive Monday, however if the same order was placed on a Tuesday it should arrive Wednesday. Deliveries are not made on a Saturday or Sunday unless previously arranged. Industrial Supplies Direct (Telford) Ltd cannot be held responsible for any delays caused by "late" delivery of goods. The delivery "cut-off" time for this site is between 2.00pm and 4.00pm depending on the brand of goods being supplied. Goods ordered after these times may add an additional 24hrs to the delivery time. Items may be ordered with different amounts of delivery time. We reserve the right to deliver all these items together, therefore the longest delivery time of items you have ordered will apply. If required, please check delivery times by going to the contact us section of this site and contacting one of our sales team.
Orders Placed By Phone:
Orders placed over the phone are bound by the same terms & conditions as orders placed on-line. Prices of items ordered over the phone are the same price as shown on the web-site unless arranged otherwise. Carriage charges for orders placed over the phone are the same as orders placed on-line and will be applied to all telephone orders unless arranged otherwise even if no carriage charge is mentioned whilst you are placing the order.
Supply of goods:
Where more than one product has been ordered but not all are available for immediate supply, we may supply the available stock straight away and the remainder once it is available. If your order is conditional on all items being supplied at once, please specify this.
Non-supply of goods:
In the event that we are unable to supply ordered goods, Industrial Supplies Direct (Telford) Ltd shall in no way be liable for any consequential loss incurred through delays in supply or failure to supply. No compensation shall be payable. All products are supplied subject to availability. We are not liable for any damages or inconvenience caused by actions or activities which are beyond our control including, but not limited to, lack of product availability from suppliers, damage caused through misuse or courier damage or defective manufacture of products which we supply.
Cancellation Of Orders Not Received:
In the event that the buyer wishes to cancel an order, before it has been received by the buyer cancellation free of charge is only possible if the order has not been processed, this is usually very soon after the order has been placed. If the goods have been despatched by a supplier, you may be liable to a re-stocking fee, which varies depending on brand. If the goods have been despatched either by Industrial Supplies Direct (Telford) Ltd or by a supplier going direct to the buyer, it is not possible to cancel this order as it will be with the courier or in transit. Any cancellations made after goods have been despatched will be liable for a re-stocking fee and carriage charges cannot be refunded. We reserve the right to determine when the order is "processed" & when it is "despatched" even if you have not been notified of this. We reserve the right to hold payment for a cancelled order for up to seven days after the order has been cancelled.
Receipt of goods:
It is for you to ensure that the person who signs for the goods is entitled so to do. We cannot be held responsible for any loss incurred once delivery to the address you have specified has been made, nor are we responsible for the goods being accepted by the incorrect recipient at the receiving address. Goods must be inspected before being signed for to ensure they are the correct goods and are free from damage. If goods are signed for and then later reported damaged we reserve the right to refuse full refund based on that damage may have been caused after receipt of goods.
Return of goods:
Goods may only be returned by specific prior arrangement and, excluding our error or if a manufacturing defect is discovered within the first 30 days, at your own cost. Goods are subject to prior inspection by either us or our suppliers before any refund is given. Return of any goods that have been bought in error or are not suitable, where the buyer wishes to return them may be liable for a re-stocking fee. Also, when refunds are given, the refund will be for the value of the goods and delivery charges cannot be refunded.
Faulty/damaged goods:
All faulty/damaged products are subject to testing prior to repair or exchange. If no fault is present then we reserve the right to charge a testing fee and to charge for return carriage.
Pricing:
We reserve the right to change prices of products without notice. We are not responsible for pricing errors made and, where such an error occurs, Industrial Supplies Direct (Telford) Ltd will not be liable to supply the goods at the erroneous price.
Special offers:
All offers are limited in supply and we reserve the right to withdraw these at any time. We cannot be held responsible if a special offer or any product is not available for supply after an order has been placed.
Order acknowledgement:
The order acknowledgement we send upon receipt of your order is not a guarantee of supply of any goods at any price. It merely confirms that your order has been received.
Delivery/ Receipt of goods:
All goods will be despatched by carrier. Goods to be delivered to home or business address as advised upon on order. Delivery of heavy items will require the recipient to make arrangements to take delivery of the goods. Delivery will require a signature which will constitute your acceptance and confirmation that the goods have arrived in good condition. Damage caused in transit may not be claimed for without the delivery docet (POD) being marked as ‚damaged‚ ('unchecked' will not be acceptable)
Damage liability:
We are not responsible for any damage or accident caused in the use of equipment purchased from us, including fire and other unforeseeable occurrences. If you wish to protect yourself against such incidents, we recommend you contact your household insurance provider.
Your order:
You confirm that any and all information you supply to us is accurate and correct and that you have read, understand and accept all our terms and conditions as outlined here.
You accept that any information you supply to us is subject to checking and approval to confirm its validity and that we may carry out any checks which we feel appropriate including, but not limited to, Credit Card address checks.
Roll Search:
Once goods are delivered you agree that you have accepted them and, once they have been opened and/or used, you acknowledge that they have been supplied in an acceptable condition and are satisfactory. This excludes issues which cannot be foreseen until such actions are taken including the discovery of a fault.
You must notify us within 10 days of our notification to you of dispatch, if your order has failed to arrive.
False Charge Backs:
If you request a chargeback from your bank and the bank does not find in your favour, we will charge you the full chargeback fee as charged to us by the bank, plus £250 for our legal expenses.
