Ai sensi del Decreto Legislativo 21 febbraio 2014, n. 21 in vigore dal 26/03/2014 codice del consumo, il cliente, se e' un consumatore, puo' avvalersi del diritto di recesso dal contratto di vendita con la ditta Listertech SRLS.

1. Il consumatore dispone di un periodo di 14 gg. dal momento di ricevimento del bene per ricorre al diritto di recesso (nuovo codice del consumo).

2. Il bene si intende consegnato a se o ad altri da lui indicati (art.52, comma.2, lettera b). Nel caso di beni multipli la data di consegna si intende quella dell'ultimo bene consegnato.

3. Prima della scadenza del periodo dei 14 gg. il consumatore deve informare Listertech SRLS dell'esercizio di recesso (art.54), presentando dichiarazione esplicita di recedere dal contratto a mezzo raccomandata con ricevuta di ritorno da inviare a: LISTERTECH SRLS VIA BADINI 16/2 40057 QUARTO INFERIORE (BO).

L'onere della prova relativa al Diritto di Recesso spetta al Consumatore (art.54, comma 4).

Nella dichiarazione vanno precisati i seguenti dati:

- Ordinato il /ricevuto il

- Nome del/dei consumatore(i)

- Indirizzo del/dei consumatore(i)

- Firma del/dei consumatore(i)

- Data

4. Listertech SRLS rimborsera' il pagamento ricevuto dal consumatore entro 14 gg. dal ricevimento della richiesta di recesso del contratto nei termini previsti dall'art. 54, comunque nei termini previsti dall'art. 56, comma 3.

Il rimborso sara' eseguito utilizzando lo stesso metodo di pagamento usato dal consumatore in fase di transazione iniziale o altro metodo espresso dal consumatore nella richiesta del Diritto di Recesso (art.56, comma 1), a condizione che Listertech SRLS non debba sostenere alcun costo quale conseguenza del rimborso.

Listertech SRLS non e' tenuta a rimborsare i costi supplementari, qualora il consumatore abbia scelto espressamente un tipo di consegna diversa dal tipo meno costoso di consegna offerto (art.56, comma 2).

Listertech SRLS non procedera' al rimborso affinche' i prodotti non saranno effettivamente giunti al proprio magazzino.

5. E' obbligo del Consumatore, restituire il bene entro i 14 gg. seguenti a partire dalla richiesta dell'esercizio del Diritto di Recesso (art. 57, comma 1).

Le spese di spedizione per la restituzione del Bene sono a carico del Consumatore (art. 57, comma 1).

Il diritto di recesso non viene applicato:

- Ai clienti non classificabili come consumatori, cioe' chi effettua un ordine indicando la Partita IVA o il Codice Fiscale per la fattura.

- In caso di bene manomesso o danneggiato dal consumatore o da terzi o con parti mancanti. In caso di bene nuovo restituito privo di imballo originale, con segni d'usura o di sporcizia.
