Diritto di recesso del Consumatore

Il Consumatore ha in ogni caso il diritto di recedere dal Contratto di Vendita, senza alcuna penalità e senza specificarne il motivo, entro il termine di 14 giorni decorrente dal giorno del ricevimento del Prodotto.

Nel caso in cui il Consumatore decida di avvalersi del diritto di recesso, dovrà darne comunicazione a Mxpositivo utilizzando i seguenti metodi: email all’indirizzo info@mxpositivo.com o raccomandata A/R all’indirizzo riportato all’interno della ricevuta fiscale o fattura allegando la ricevuta fiscale e/o la fattura d’acquisto in originale.

Mxpositivo procederà ad effettuare le debite verifiche e, nei 3 giorni successivi la richiesta di recesso, invierà l’Autorizzazione al Reso del Prodotto.

Senza l’Autorizzazione al Recesso da parte di Mxpositivo, il Cliente non è autorizzato a procedere con la spedizione o la riconsegna dei prodotti.

La riconsegna del Prodotto a seguito dell’Autorizzazione al Reso dovrà comunque avvenire al più tardi entro 14 giorni lavorativi dalla ricezione della predetta Autorizzazione e dovrà essere effettuata:

- tramite spedizione all’indirizzo riportato nella ricevuta fiscale o fattura

- tramite consegna diretta nella sede di Mxpositivo previo appuntamento prestabilito se il recesso è valido.

Il Consumatore provvederà ad utilizzare una modalità di spedizione ed imballo adeguata alla tipologia di prodotto, al fine di riconsegnare a Mxpositivo il Prodotto integro in ogni sua parte.

In ogni caso, per aver diritto al rimborso del prezzo pagato, il Prodotto dovrà essere restituito integro, in normale stato di conservazione, imballato nella confezione originale, e, completo di ogni accessorio, dei manuali di istruzione e di tutto quanto in origine contenuto. In caso di spedizione, il Cliente dovrà apporre, esternamente all’imballo, il modulo di autorizzazione del Reso.

Le spese di restituzione del prodotto sono a carico del Consumatore.

In caso di esercizio del diritto di recesso da parte del Consumatore, Mxpositivo accrediterà o effettuerà il rimborso entro i 14 giorni successivi alla ricezione dei prodotti oggetto di recesso.

Mxpositivo rimborserà esclusivamente i prodotti integri nell’imballo originale e in normale stato di conservazione e non sarà tenuta a rimborsare i costi supplementari, come, a titolo esemplificativo, i costi di preparazione, spedizione e/o qualora il Consumatore abbia scelto espressamente un tipo di consegna diversa e più onerosa a quella standard proposta da Mxpositivo, i costi dei servizi extra.

Non saranno ritenuti valide le richieste di recesso per ordini errati su misure pistoni, errori di annate moto, e incompatibilità prodotto ordinato per la propria moto. Per dubbi su compatibilità e annate corrette del proprio mezzo il Cliente sarà tenuto preventivamente a comunicare con Mxpositivo tramite mail a info@mxpositivo.com o via telefonica 347/8309878 per potere essere guidato in maniera corretta a eseguire un ordine corretto in tutte le sue parti previa verifica effettiva compatibilità. A tal proposito gli ordini dei Prodotti con misure centesimali o millesimali dovranno essere fatti da personale specializzato o essere fatti dopo reale misurazione da parte del Cliente con strumenti adeguati.

Diritto di recesso e Garanzia del Professionista

Secondo quanto stabilito dalla Legge, il diritto di recesso è riservato esclusivamente ai Consumatori (persone fisiche che acquistano i beni non per scopi legati alla propria attività professionale, commerciale o imprenditoriale), quindi non può essere esercitato dalle persone giuridiche e dalle persone fisiche che agiscono per scopi riferibili all'attività professionale eventualmente svolta.

In via del tutto eccezionale Mxpositivo garantisce anche ai Professionisti la possibilità di accedere alle clausole del capitolo 8.

In particolare il Professionista può far valere la garanzia, purché denunci il vizio del Prodotto entro otto giorni dalla scoperta.

Per esercitare la Garanzia Legale il Professionista avrà la possibilità di inoltrare la segnalazione all’indirizzo e-mail info@mxpositivo.com .
