DIRITTO di RECESSO

Le vendite on line sono soggette al diritto di recesso ai sensi dell'art. 64 del D.Lgs. 206/05. Il cliente che intenda esercitare il diritto di recesso deve darne comunicazione, entro gg. 10 (dieci) lavorativi dalla ricezione della merce, con una e-mail e deve contenere:

- la manifestazione di volontà di avvalersi dei benefici concessi dalla legge

- l’indicazione del prodotto relativo

-il numero dell'oggetto “e Bay” i dati relativi al proprio conto corrente bancario o postale.

Per ottenere il rimborso del corrispettivo, entro lo stesso termine di gg. 10 (dieci) dalla ricezione della merce, il cliente dovrà inoltre rispedire al mittente a mezzo posta o corriere il prodotto relativamente al quale intende esercitare il diritto di recesso completo della eventuale relativa fattura di vendita. Entro 7 (sette) giorni dalla ricezione del reso, provvederemo al rimborso mediante bonifico bancario. Il suddetto rimborso si riferisce esclusivamente al prezzo del prodotto; in ogni caso le spese accessorie di spedizione e consegna a domicilio non saranno oggetto di rimborso e, pertanto, rimarranno a carico del cliente. Il diritto di recesso è comunque sottoposto alle seguenti condizioni:

- il diritto si applica al prodotto nella sua interezza;

- il bene acquistato dovrà essere integro e non danneggiato in alcun modo e restituito nella confezione originale, completa in tutte le sue parti (compresi imballo ed eventuale documentazione e dotazione accessoria: manuali, cavi etc).

La spedizione, fino all'attestato avvenuto ricevimento nel magazzino della società è sotto la completa responsabilità del cliente; in caso di danneggiamento del bene durante il trasporto la società darà comunicazione al cliente dell'accaduto (entro i cinque giorni lavorativi dal ricevimento del bene nei propri magazzini), per consentire allo stesso di sporgere tempestivamente denuncia nei confronti del vettore. In questa eventualità, il prodotto sarà messo a disposizione del cliente per la sua restituzione, contemporaneamente annullando la richiesta di recesso. Il diritto di recesso decade totalmente, per mancanza della condizione essenziale di integrità del bene (confezione e/o suo contenuto), nei casi in cui si accerti:

- la mancanza della confezione esterna e/o dell'imballo interno originale;

- l'assenza di elementi integranti del prodotto (accessori, cavi, manuali, parti etc.)

- il danneggiamento del prodotto per cause diverse dal trasporto. Nel caso di decadenza dal diritto di recesso, la società provvederà a restituire al cliente il bene acquistato addebitando allo stesso le spese di spedizione.
