Il diritto di recesso è regolato dal D.Lgs. n. 206 del 06/09/2005. Per esercitare tale diritto il Cliente dovrà inviare a una comunicazione entro 30 giorni lavorativi dalla data di ricevimento della merce a mezzo lettera raccomandata con ricevuta di ritorno indirizzata a: AL.PI. S.r.l.s. – V.le Vittorio Veneto, 95/97 – 47122 Forlì (FC). La comunicazione potrà essere anticipata anche tramite posta elettronica all'indirizzo info@farmanaturashop.it, purché confermata con raccomandata a/r entro 48 ore.

Attenzione: Non possono esercitare il diritto di recesso i clienti che acquistano con Partita IVA.

Il diritto di recesso è comunque sottoposto alle seguenti condizioni:

- ai sensi del "Codice del Consumo" Decreto Legislativo 6 settembre 2005, n. 206 e successive modificazioni,art. 47 1.b, il diritto di recesso non si applica alla fornitura di medicinali e dispositivi medici, indipendentemente dallo stato in cui si trova il prodotto;

- il diritto si applica al prodotto acquistato nella sua interezza completo di accessori, allegati, ecc.;

- il diritto si applica ai prodotti acquistati esclusivamente sul negozio Farmanaturashop;

- la restituzione del prodotto dovrà avvenire entro un termine non superiore a 30 gg. lavorativi a partire dal ricevimento della merce.

- il bene acquistato dovrà essere integro e restituito, a spese dell'acquirente, nella confezione originale, completa in tutte le sue parti (imballo, pellicole di protezione esterne, documentazione e dotazione accessoria: manuali, cavi, ecc.), va evitata l'apposizione di etichette o nastri adesivi direttamente sulla confezione originale del prodotto;

- nel caso l'acquisto riguardi ALIMENTI, INTEGRATORI ALIMENTARI o prodotti ad essi assimilabili, gli articoli oggetto di reso dovranno presentare le pellicole di protezione esterne (ove previste), si invita altresì il cliente a non aprire i prodotti integratori alimentari prima di aver verificato la rispondenza con quanto ordinato, in caso di prodotti aperti non si accetteranno resi;

- a norma di legge le uniche spese a carico del cliente sono le spese di spedizione relative alla restituzione del bene;

- la spedizione è sotto la completa responsabilità del Cliente; in caso di danneggiamento durante il trasporto, AL.PI. S.r.l.s. darà comunicazione al Cliente dell'accaduto (entro 5 giorni lavorativi dal ricevimento del bene nei propri magazzini), per consentirgli di ottenere il rimborso del valore del bene (se assicurato); in questa eventualità, il prodotto sarà a disposizione del Cliente per la sua restituzione, contemporaneamente annullando la richiesta di recesso.

Fatte salve eventuali spese di ripristino per danni accertati all'imballo originale, AL.PI. S.r.l.s. provvederà a rimborsare al Cliente l'intero importo già pagato, entro 30 giorni dal ricevimento della comunicazione di recesso, ad eccezione delle spese di spedizione, a mezzo Bonifico Bancario. Pertanto sarà cura del Cliente fornire tempestivamente le coordinate bancarie sulle quali ottenere il rimborso (Cod. ABI – CAB - Conto Corrente dell'intestatario della fattura).

Il diritto di recesso decade totalmente, per mancanza della condizione essenziale di integrità del bene (confezione e/o suo contenuto), nei casi in cui FarmaNaturaShop.it accerti:

- utilizzo anche parziale del bene e di eventuali materiali di consumo;

- la mancanza della confezione esterna, comprese pellicole di protezione esterne, e/o dell'imballo interno originale;

- il danneggiamento del prodotto per cause diverse dal suo trasporto;

- l'assenza di elementi integranti del prodotto (accessori, parti, ecc.);

nei casi sopra indicati, FarmaNaturaShop.it provvederà a restituire al mittente il bene acquistato, addebitando allo stesso le spese di spedizione.
