TERMS AND CONDITIONS of the sale
1. Terms and Conditions, Contract agreement of any sale between the company and the customer.
1.1 The company is Evolve Install ltd. Company Number 10390647
1.2 The customer is any individual/s or company who purchase or agree to purchase goods from the company.
1.3 The company’s acceptance of the customer/s order by delivery of the goods constitutes a legally binding contract, and agreement to these terms and conditions.
2. Conditions Applicable
2.1 Terms and Conditions shall apply to all agreements for the sale of goods entered into by the company. All conditions of the Customer or other terms and conditions or warranties whatsoever are excluded from the contract or any variation there of unless expressly accepted by the company in writing.
2.2 The exercise by the Company of any right pursuant to these Terms and Conditions shall be without prejudice to any other right available to it whether hereunder or under general law.
3. Delivery and Title
3.1 The company shall deliver the goods in accordance with the customer/s order and chosen delivery / Carrier service. A valid signature maybe required on collection or delivery, including third (3rd) Party carrier company/s. Immediately prior to dispatch of the goods to you, title in the goods will pass to you. In the unlikely event that you have not received some / all the goods within 21 days of the date of delivery, the customer/s are obligated to notify us immediately.
4. Cancellation, Termination and Returns
4.1 Cancellation, suspension or variation by the Customer of any agreement accepted by the Company shall not be valid unless agreed by the Company in writing, and such agreements may only be given on terms which compensate the Company for any loss, costs, damages, charges and expenses thereby incurred by the Company, such compensation to be decided by the Company in its absolute discretion. In particular, the Company reserves the right to charge a 20% handling charge for goods which are accepted back into stock for credit, although the Company s claim in this regard may not be limited to this sum.
4.2 The Company reserves the right to make any changes in the specification of goods which are required to conform with any applicable safety or other statutory requirements.
If you are dissatisfied with the product due to any points stated in this section of the Terms & Conditions, you are entitled to a full refund.
4.3 On cancellation, the customer/s must return the goods to us at your cost unless the good/s are being returned due to incorrect delivery by either the fault of the company or for reasons mentioned in section 4.2.
4.4. The company shall delivery the product in suitable packaging, if the customer/s are returning, then suitable packaging must also be used to keep the product in a suitable condition valid in return.
4.5 We may suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you.
4.6 If the customer changes their mind, or the good/s purchased is unsuitable from our online store or third (3rd) Party seller websites, the customer can return the good/s to the company at the customer/s cost within 14 days of the delivery date together with the original packaging in Saleable Condition and the company can either exchange the item or provide a full refund via the same method of payment transaction/s.
4.7 The company makes every effort to describe goods accurately however we cannot accept liability for errors or if slight variations in the actual goods.
4.8 All returns must have a validated by the company prior to return. This must be conducted by e-mail, or suitable written communication methods.
4.9 Good/s that are received damaged must be reported to the company within 48 hours of delivery. This is a stipulation of the insurance cover in place with our carrier services. We will either exchange them or provide a full refund using the same method of payment, this will be provided at the company cost. This does not affect your statutory rights as a consumer.
4.10 The company will not refund any carriage charges incurred by the customer unless the costs incurred are by direct fault of the company or for reasons mentioned in section 5.2.
5. Price & Payment
5.1 The price payable for the goods the customer/s order is as set out on the price stated when confirming your order, plus any carriage charge as stated in the carriage & postage section.
5.2 The company must receive payment for the complete order, at the current price of the good/s the customer/s has ordered, and any applicable charges for carriage before your order can be accepted unless we have agreed otherwise in advance in writing.
6. Warranty & Guarantee
6.1 Subject as expressly provided in these Terms and Conditions and except where good/s are sold or services provided to a person dealing as consumer within the meaning of the Unfair Contract Terms Act 1977 all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permissible by law.
6.2 All warranty times are governed solely by the manufacturer/s terms and conditions.
6.3 All our good/s carry a standard one hundred and sixty-eight days (168) guarantee, the company may at its discretion extend or shorten this warranty in line with the Manufacturers terms and liabilities.
7. Liability
7.1 If the customer has notified us of a problem with the good/s, the company will either make good any shortage or genuine non-delivery; replace or repair any good/s that are damaged or defective upon delivery; or refund to the customer the amount paid for the exact same quantity as notified for the goods in question in line with the terms and conditions set out under Cancellation, Termination and Returns. The company will not be liable to the customer for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the good/s and the company shall have no liability to pay damages by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer.
7.2 The company sells these good/s for particular use/Purpose, the company can not be held responsible for non-intended use and shall exclude our liability to the customer for fraudulent misrepresentation or for death or personal injury resulting from the customer/s negligence.
8. Force Majeure
8.1 The company shall have no liability to you for any failure and/or delay in supply, delivery delay or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond the company/s reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).
9. General
9.1 If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.
10. VAT
10.1 All prices at completion/time of order include VAT. Goods not subject to VAT are exempt, and shall have a written invoice.
11. Age Requirement/s for Specific Good/s
11.1 Where the local law requires a minimum age limit for the purchase of specific good/s, the customer confirms they are of suitable required age limit and the person that will accept delivery is also suitable requirement to the age limit.
