Terms of Use
By purchasing you understand and agree that Nevlock Performance LTD shall not be liable for any damages caused, whether direct, indirect, incidental, consequential or exemplary, including but not limited to, damages for loss of profits, data, material items, life or other intangible losses (even if we have been made aware of the possibility of such damages), resulting from the use or the inability to use the product(s) and or service(s) or any misuse of the product(s) and or service(s) in a manner not in accordance with their intended use.
Buying Products from our eBay store
To order Products you will need to follow the ordering procedures set out here.
1. Details of prices for our Products, and the procedures for payment and delivery are displayed on our eBay shop.
2. Any times or dates stated on our eBay shop for delivery are estimates only. We will make all reasonable efforts to deliver the Products within the time specified, but do not accept any liability for any failure to deliver within the quoted time, or for any consequences caused by the delay, including but not limited to loss of earnings or a stern telling off by your boss. If, by mistake, we have something listed that has gone out of stock, we will do our best to inform you of this as early as possible, and to inform you of a revised time scale, or refund you if this is unacceptable or too inconvenient.
3. Products will not be dispatched to you until we are in receipt of cleared funds. The price of any Product is the price in force at the date and time of your order. We may change the price of any Product before you place an order. We try to ensure that our prices displayed on our eBay shop are accurate but the price on your order will need to be validated by us as part of the acceptance procedure (see clause 4, below). We will inform you if a Product’s correct price is higher than that stated in your order and you may cancel the order and decide whether or not to order the product at the correct price. If your credit card has already been charged we will immediately issue a credit to your credit card account to the value of the incorrect price (including delivery charges). The prices are inclusive of applicable taxes. If the price is lower than that advertised we will refund you the difference, possibly without mention via the messaging service.
4. We are entitled to refuse any order placed by you, or to cancel and refund an order at any time. If your order is accepted, we will confirm acceptance to you by online electronic means (‘Confirmation’) to the e-mail address you have given to us upon ordering. The order will then be dispatched in as timely order as possible, and you will be informed of any possible delays if they come up. (See clause 2 above, and 7 below)
5. You undertake that all details you provide to us for the purpose of purchasing the Products offered by us on our eBay shop are correct, that the PayPal account, credit or debit card which you use is your own, or that you are authorised to use it and that there are sufficient funds or credit facilities to cover the cost of any Products. We reserve the right to obtain validation of your credit or debit card details before providing you with any Products.
6. We do not store credit card details, nor do we share customer details with any 3rd parties.
7. All Products and services are subject to availability and may be withdrawn at any time. If we do not supply the Products for any reason we will not charge you and we will refund any money already paid by you.
8. We utilise the FedEx / ups & Royal Mail services for the delivery of most items. This means that we will have a receipt of postage, and a tracking number for you to follow your items progress.
9.Unless otherwise stated, all vehicle parts sold by us are intended for off road/race use only and must be installed by an experienced professional. We accept no responsibility for any additional costs incurred through incorrect fitting of any products sold by us. We also do not accept responsibility for any damage caused to any other components as a result of the failure of a product sold by us.
10. All of the Products that we supply are covered by these terms and conditions.
