This website is operated by UK Bargains Ltd (referred to as "UK Bargains Ltd/we/our/us"). As user of this website (referred to as "you/your/the buyer") you acknowledge that any use of this website including any transactions you make ("use/using") is subject to our terms and conditions below.
1. General
1.1. We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the top) and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.
2. Returns, Cancellations and Substitutions
2.1. In accordance with the Consumer Rights Act 2015 and the Consumer Contracts Regulations Act 2013, the buyer/consumer is entitled to a 30 day right of cancellation from the date of purchase. The 30-day period of consumer cancellation rights gives the consumer the legal right to request either a refund of the item(s) value amounting to the same monetary value of which the item(s) was originally purchased for, excluding postage costs. After the 30 day right of cancellation we do not accept returns.
If the item purchased is faulty then please contact us within 24 hours from receiving the item and provide full details of the problem. Please keep all of the original packaging which helps us to further investigate the problem. If the item was purchased by mistake, we will be happy to refund the purchase price excluding postage and packaging as long as the item is unopened, in its original packaging and the security seal is still intact with both the item and packaging undamaged. Any item intended for return must be done so at the full expense of the buyer. If the original purchase qualified for Free P&P and the buyer chooses to return any part of the entire order, the buyer will be responsible for the postage and packaging cost that we incurred to ship the item (s) to the buyer. Please note that if the item is not delivered due to an address query the buyer is fully responsible for the carriage cost and the return postage cost.
2.2. In the event that UK Bargains Ltd is not able to provide a replacement due to stock depletion or unforeseen circumstances which may permit or hinder the capability of UK Bargains Ltd to provide a replacement item, UK Bargains Ltd in these circumstances holds no liability for any financial losses accrued resulting from this.
2.3. PLEASE RETURN GOODS VIA RECORDED DELIVERY ONLY. DO NOT USE SPECIAL DELIVERY. If goods are not sent back to us by recorded delivery and/or in case the goods are lost or not received, UK Bargains Ltd cannot be held responsible for any loss sustained.
2.4. Sometimes the product specifications from the supplier or manufacturer may change, in which case we will do our best to offer you a similar alternative. We may experience problems with the supply of certain products and may therefore supply a substitute of the same or better quality at the same price. If you are not happy with the replacement or substitute you can return it in accordance with our 30-day money back guarantee. Where applicable, you may cancel your order in accordance with your rights under the Consumer Contracts Regulations.
2.5. For Hardware products, if you believe your item is faulty, we ask that you first contact the manufacturer for assistance. Details on how to contact the manufacturer can usually be found with the manual that comes with the product. The manufacturer will be able to offer the best possible advice to help you get your product working and diagnose if it is actually faulty.
2.6. This returns policy does not affect your statutory rights as determined by the Consumer Goods Act 2015.
3.Terms of Sale
3.1. When you place an order with us, you are making an offer to buy the goods. We will send you an e-mail to confirm that we have received your order.
3.2. We will review your order and we will e-mail you to confirm that we accept your order, and that a contract has been made between us.
3.3. We only ship items to addresses registered on eBay and cannot amend the delivery address after the order has been placed.
3.4. Items sent to the Scottish Highlands, Northern Ireland, Channel Islands and any Off-Shore Islands will incur an additional courier surcharge depending on the value and size of the order. We will where possible ship items by Royal Mail free of charge however heavier/ larger items will need to be sent by courier and a surcharge payment will be required.
3.5. Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.
3.6. Risk of loss and damage of products passes to you on the date when the products are delivered to you or are left with a person or place nominated by you.
3.7. In relation to the delivery period, a minimum of 30 days default delivery is in operation in accordance with the Consumer Rights Act 2015 from the date of purchase being made regardless of the stated estimated delivery times. UK Bargains Ltd will, however, endeavour to have the item delivered in accordance with its stated estimated delivery times. Any delivery which exceeds the 30-day delivery period in accordance with Consumer Rights Act 2015 the buyer/consumer is entitled to a full refund of the originally transacted price excluding standard or premium delivery charges used for postage from the original purchase and upon receipt of evidence that the item was not delivered within the 30 timeframes of intended delivery.
3.8. By placing an order with us, you agree to and accept these terms.
Payment
4.1. We take payment from your card or PayPal account at the time we receive your order, once we have checked your card or PayPal details and stock availability. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods upon cancellation of the order by the buyer. Additional Terms and Conditions for payments made by PayPal can be found at www.paypal.co.uk.
4.3. Online price errors. If we discover an error in the price of goods ordered or reserved, we will inform you as soon as possible. We will provide you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you choose to cancel and have already paid for the goods you will receive a full refund.
For Click & Collect orders where payment is made at the time of ordering for in store collection, the price you pay is the price specified at the point of placing the order and not the prevailing price in store at the time of collection.
5. Liability and Indemnity
5.1 UK Bargains Ltd will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any of the following:
economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or
loss of goodwill or reputation; or
loss of privacy and loss of data; or
special or indirect losses
suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.
5.2. Notwithstanding the above, subject to Section 5.1 UK Bargains Ltd aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.
5.3. This clause 7, including clause 7.1 and 7.2 does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.
5.4. UK Bargains Ltd shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.
