The following terms and conditions apply to your use of our eBay Shop. By using our eBay Shop and by placing an order with us, you agree to be bound by our terms and conditions as set out below. All other terms and conditions, express or implied by statute or otherwise are excluded to the fullest extent permitted by law. Nothing in these terms and conditions is intended to limit your statutory consumer rights.
1. Orders
1.1 Our acceptance of your order and formation of a binding contract occurs when we dispatch your order from our warehouse. If we chose to end this contract, we will notify you in writing as soon as possible and refund any transaction within 7 days. If we cannot accept your order, we will inform you of this in writing and will not charge you for the goods. This may be because the goods are out of stock, because of unexpected limits on our resources which we could not have been reasonably planned for, because we have identified an error in the price or description of goods or because we are unable to meet a delivery deadline you have specified.
2. Payment
2.1 Payment must be made in full before your order is processed unless otherwise agreed in writing by us. Once we receive payment, we will confirm, and your order will be approved provided there is nothing preventing us from doing so. Acceptance of your order and completion of the contract between you and us takes place on the dispatch (i.e. sending) of the products ordered.
3. Prices
3.1 Prices are as set out on our Beauty Scent eBay Shop. These prices include UK Value Added Tax at the prevailing rate.
4. Delivery charges
4.1 Delivery costs:
UK standard delivery: £2.99
The UK Next Day Delivery: £3.99 (order before 2pm Monday to Friday (receive Monday – Saturday)
NB Next Day Delivery to the British Highlands, Islands and Northern Ireland has a delivery estimate of 8 working days and cannot be delivered on Saturdays or Sundays.

5. Cancellation and Returns Policy
5.1 The Cancellation and Returns Policy applies when there is no fault with the products you have ordered. If there is a fault, please see section 8, “Defective Products”, instead. Our Cancellation and Returns Policy intend to be legal, fair and equitable for you, us, our suppliers and other Customers; we aim to treat you as we ourselves would expect to be treated.
5.2 Right for you to make changes/cancel your contract.
If you wish to make a change to the goods you have ordered, please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the goods, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to end the contract.
Exercising your right to cancel (Consumer Contracts Regulations 2013) applies to most goods bought online, and you have a legal right to cancel your order within 30 days of delivery and receive a refund. However, please note that you do not have the right to cancel in respect of any sealed goods once they have been unsealed.
To cancel your order, please write a letter or send an e-mail to us stating that you wish to exercise your statutory right to cancel, including your full name, address and order number. Please address any letters to Beauty Scent; Churchill Point, Lake Edge Green, Trafford Park Road, Manchester, M17 1BL.
If you decide to contact us by e-mail, we will aim to reply confirming receipt of the e-mail within two working days. Your item must be re-packaged securely and sent to us within 30 days of the date you notified us of your intention to cancel. Please note you will be responsible for the costs of returning the goods to us unless we delivered items to you in error or the item is faulty.
If you do not return the item within 30 days, we may either withhold the refund or arrange for collection of the item from you at your cost.
We reserve the right to deduct monies from refunds where the goods show signs of unreasonable use leading to diminished value.
If the item you wish to return is faulty, please refer to 8, “Defective Products”.
If you cancel your order before the item has been dispatched, then we will be able to give you a full refund for your order. Please be aware that orders are processed automatically and, as we offer a next working day service, they are dispatched quickly.
If you cancel your order after it has been dispatched, then the item will need to be returned. Please be aware that if you refuse delivery of an item, the cost of the return carriage will be deducted from your refund. If you refuse an item because it is damaged, then please see section 8, “Defective Products”, instead.
We will charge you a fee for collection. If you wish to arrange the return yourself, you must use a secure courier who provides us with full traceability. You must contact us for returns information before sending.
Cancelled and returned items will be re-credited as soon as possible after the products if dispatched, have been returned and inspected. As set out above, for returned items we reserve the right to deduct the cost of return carriage and a fee, that depends on the state of the returned products and packaging, from the amount we re-credit to you.
6. Cancellation by us
6.1 We reserve the right to cancel your order if there is insufficient stock; or we do not deliver the products you have ordered to your area; or the pricing was incorrect.
6.2 If we cancel your order, we will notify you by e-mail and will credit you as soon as possible.
7. Delivery of products to you
7.1 Delivery of the products you ordered will be made to the delivery address you give us at the time of your order. Please ensure you check the delivery address to make sure it is accurate. We cannot be held responsible and accept no liability for any incorrectly entered delivery addresses.
7.2 Delivery will be made as soon as possible following your order.
7.3 Ownership of the products passes to you on delivery. After that, we have no further liability for loss, theft or destruction of the products.
7.4 When ordering the goods for delivery overseas, your order maybe subject to import duties and taxes which are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you. International deliveries are subject to opening and inspections by customs authorities.
During periods of severe weather conditions, all our delivery methods may take longer than expected. We aim to keep you informed of any developments. We always advise you to place your orders with plenty of time, especially when forces beyond our control come into play. If there is a substantial delay, you may contact us to end the contract and receive a refund for any goods you have paid for but not received.
If you are not at home when the goods are delivered, and no one is available at your address to take delivery, and the goods cannot be posted through your letterbox, we will leave you a note informing you of how to rearrange delivery or collect the goods from a local depot. Goods that are returned to us will incur a further delivery charge.
If you do not rearrange delivery after a failed delivery or collect them from a delivery depot, we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If despite our reasonable efforts, we are unable to re-arrange delivery, we may end the contract at our discretion.
Please ensure that the delivery address you enter is correct as we will not be liable for failed delivery due to inaccurate information provided by you.
8. Errors in delivery; damaged, defective or incorrect products
If you receive an item that is faulty or incorrect, please notify us within 90 days. We will replace the goods or refund your payment, as appropriate. Please make sure you retain all original packaging, including outer packaging, to use if returning the goods.
If the goods are incorrect please return them without removing the cellophane wrapper. To return an item, PLEASE OBTAIN AN RMA NUMBER (returns number)
*We cannot offer a refund or a return on an item unless you retain the item and its original packaging.
The Return of unwanted items is at our discretion and we will only consider returns on goods that are unopened and in original condition with all tags and/or packaging
8.1 If any products delivered are not what was ordered, or are damaged, or defective, or incorrect quantities, you need to inform us within 10 days of dispatch. We will look to take one or more of the following actions:
• Make good any errors in delivery; or
• Repair or replace any products that are damaged or defective; or
• Adjust the delivered quantity to the original order; or
• Provide you with a full or partial refund.
If an item fails to arrive with you after being dispatched by ourselves, we have to wait for a period of 15 working days (10 working days for next day delivered items) from the date of dispatch before we can offer a refund or re-delivery of the item. This is due to the fact our couriers will not consider an item lost until this point, so it is still likely the item may still arrive.
If the item does not arrive within this period, we will ask you to sign and return a form confirming that you have not received your order before we process a refund or re-delivery. Please note that any non-delivered items must be reported to us in writing or e-mail within 10 days of dispatch. Any issue reported to us outside of this time period will not be able to be refunded or replaced.
8.4 Except as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) however so caused and we have no liability to pay compensation beyond the refund of the purchase price of the products.
9. eBay Shop
9.1 We aim to ensure that the information available on our eBay Shop is accurate. However, we will not be held liable for any errors or omissions. We will use all reasonable care to correct any errors or omissions as quickly as practicable after being notified.
9.2 Goods may vary slightly from their picture. All photography is for illustrative purposes only, and the actual item may vary in colour, design, and size. The packaging of the goods may vary from that shown in images.
9.3 We may also change, suspend or discontinue any aspect of our eBay Shop, including the availability of any products featured, information, database or content or restrict access to parts or all of the eBay Shop without notice or liability.
10. Notices
10.1 Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be sent via eBay.
10.2 All notices from us to you will be via the e-mail, telephone and/or postal address details you provide to us. Public notices are displayed on our website from time to time.
11. Events beyond our control
11.1 We shall have no liability to you for any failure to deliver products you have ordered or any delay in doing so or for any damage or defect to products delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, pandemics, governmental action, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
12. Invalidity
12.1 If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
13. Privacy
13.1 We strictly adhere to all applicable Data Protection legislation, including but not limited to the Data Protection Act 2018 and the General Data Practice Directive.
14. Third-party rights
14.1 A person who is not a party to this agreement has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
15. Governing law
15.1 The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
16. Entire agreement
16.1 These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the products to you by us. Nothing said by any person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any products offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
