This user license agreement (the Agreement) is an agreement between you (individual or single entity) and Lecsoft for the Exam Simulator program (the Software) that is accompanying this agreement.
Please read the following terms and conditions carefully before using this SOFTWARE PRODUCT. Your use, distribution or installation of this copy of “Lecsoft Exam Simulator” indicates your acceptance of this License.
Lecsoft Exam Simulator here means Software, image files, all accompanying files, data and materials received with your order of “Lecsoft Exam Simulator”.
The Software is the property of Lecsoft and is protected by copyright laws and international treaties. The Software is not sold, it is licensed.
The Licensed Version means a Registered Version (using your personal serial/activation code).
If you do not agree to any of the terms of this License, then do not install, distribute or use the Lecsoft Exam Simulator.
Warrantee covers defects in the software, which prevents successfully installing the software in the buyer’s PC. Warrantee does not cover fitness of purpose, not meeting of expectations or needs in the mind of the buyer.
This Lecsoft Exam Simulator is for personal use only and may be installed and used by on only one computer. Its component parts may not be separated for use on more than one computer. Lecsoft Exam Simulator may be accessed through a network only after obtaining a site license. All components accompanying the software are copyrighted by Lecsoft and may not be taken apart, modified, used or published with other software or means except with the Lecsoft Exam Simulator software and may not be distributed or copied in any manner.
This Lecsoft Exam Simulator, all accompanying files, data and materials, are distributed “AS IS” and with no warranties of any kind, whether express or implied. The user must assume all risk of using the program. This disclaimer of warranty constitutes an essential part of the agreement.
Please note that all questions/answers have been checked but no responsibility will be accepted for any incorrect advised answers. Any liability of Lecsoft will be limited exclusively to refund of purchase price. In addition, in no event shall Lecsoft be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of Lecsoft Exam Simulator.
This Agreement constitutes the entire statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by UK laws.
Lecsoft the owner of the copyright of this Lecsoft Exam Simulator, all of its derivatives, title and accompanying materials are the exclusive property of Lecsoft. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by Lecsoft. You may not rent, lease, transfer, modify, translate, reverse engineer, de-compile, disassemble, make any attempt to bypass/unlock/disable any protective system on the software or create derivative works based on this Lecsoft Exam Simulator. You may not copy the documentation accompanying the software, upload or transmit the software, or any portion thereof, to any electronic bulletin board, network, website, or other type of multi-use company system regardless of purpose. You may not include the Software in any commercial products intended for manufacture, distribution, or sale.
This is a single license product, you may not install this software on another PC without purchasing an additional license. Once a license has been activated, it cannot be transferred, resold, rented, leased or activated on another PC. Internet access is required to run and activate the software. In consideration of you paying the license fee and performing your obligations under these terms and conditions, we grant you a non-exclusive, non-transferable license to use the Exam Simulator for licensed use.
You may not disclose to other persons the data or techniques relating to this Lecsoft Exam Simulator that you know or should know that it is a trade secret of the Lecsoft in any manner that will cause damage to Lecsoft. Screenshots of any of the questions or software are not permitted, if screenshots have been taken, your software license will be revoked and the Exam Simulator deactivated, no refund will be given for violation of these terms. You may also be liable for any damages caused by this violation and copyright infringement.
This Lecsoft Exam Simulator and all services provided may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any UK law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. You agree to indemnify and hold Lecsoft harmless from any claims resulting from the use of this Lecsoft Exam Simulator, which may damage any other party.
The Lecsoft Exam Simulator is not endorsed by City and Guilds, the software and questions are written by ourselves . From time to time some of the material used is taken from external sources, if you suspect the material comes from a dubious source please contact us.
REMOTE DESKTOP SUPPORT DISCLAIMER
By requesting and accepting a remote session from a Lecsoft representative to remotely assist you with a technical related issue, you accept responsibility for any changes made to the desktop content or system settings. Lecsoft does not assume and is not responsible for any liability for the linking and viewing of any desktop content, the operation of the Lecsoft Support software or system performance.
Lecsoft recommends for your security and privacy that you exit any applications you have open that is displaying content such as personal or confidential information before initiating a remote support session with a Lecsoft representative. Lecsoft further recommends that you remain seated at your desktop throughout the entire remote session.
Your data is important to us. It is up to you to ensure that you backup your data on a regular basis. Lecsoft will not be held responsible for any data loss if any occurred during or after a remote session. If you require help in setting up a backup procedure for your data please do not hesitate to contact us for further assistance.
Lecsoft continuously undertakes to take the utmost care when in use of your computer. However, Lecsoft cannot guarantee that our service will resolve your problem or that attempting to rectify your technical issue will not cause additional problems.
By using this Remote Support Service you understand that:
All remote service and software provided “as is” and at customers sole risk.
You are responsible for the backup of your data and applications.
Lecsoft is not liable for consequential damages of any kind.
By downloading and opening our remote support software, you accept these conditions.
By installing the Lecsoft Exam Simulator you acknowledge that you have read this agreement, understand it and agree to be bound by its terms and conditions. You also agree that this agreement is the complete and exclusive statement of the agreement between you and the company and supercedes all proposals or prior endorsements, oral or written, and any other communications between you and the company or any representative of the company relating to the subject matter of this agreement.
