Die Arbeit untersucht die Moeglichkeiten und Grenzen einer Einbeziehung der Normen des voelkerrechtlichen Menschenrechtsschutzes in die allgemeine Vorbehaltsklausel des deutschen Internationalen Privatrechts. Nach einer einfuhrenden Darstellung zu Funktion, Strukturprinzipien und Anwendungsvoraussetzungen von Art. 6 EGBGB gewahrt die Untersuchung einen UEberblick uber die elementaren Bestandteile des regionalen und universellen Menschenrechtsschutzes und seiner UEberwachung auf voelkerrechtlicher Ebene. Im zentralen Teil der Arbeit werden die Grundlagen einer menschenrechtsbezogenen Anwendung der ordre public-Klausel aufgezeigt. Es wird dargelegt, inwieweit die Normen des internationalen Menschenrechtsschutzes zur Konkretisierung der international-privatrechtlichen Vorbehaltsklausel herangezogen werden koennen und welche Folgerungen sich dabei fur die Anwendung von Art. 6 EGBGB ergeben. Die Ergebnisse dieses Abschnitts werden im Schlusskapitel exemplarisch anhand des internationalen Eheschliessungsrechts umgesetzt und konkretisiert.
