Terms and conditions of the sale

Payment

Cash Sales. Payment becomes due from the date on the invoice.

Credit Account

Payment becomes due the date of invoice raised. Payment of such invoices should be made no later than the end of the month succeeding the month that such invoices have been raised.

This allows an account customer 30 days credit. If the customer exceeds these credit terms the supply of goods/services will be suspended and the customers account terms will be reviewed.

Title of Goods

It is a condition of sale that all goods supplied by Midland Turbo will remain the property of Midland Turbo and the title of such goods shall not pass to the purchaser until they have been paid for in full. In the event of the purchaser defaulting on payment for any reason including bankruptcy or insolvency, the purchaser will authorize Midland Turbo to enter the purchasers property where the goods are stored and remove all goods supplied by Midland Turbo, up to the value of the debt.

Midland Turbo shall give credit to the purchaser for all the goods repossessed.

Reconditioned Exchange Product

To be acceptable for exchange all old units must conform to the following specifications:-

1) Must be a complete unit (not in pieces).

2) Must be the same part number as original unit supplied.

3) Must have not suffered accidental or deliberate damage.

4) Must not be heavily corroded.

Surchargers

A surcharge shall be applied to the exchange product if old units are not returned at the time of sale. See a current price list for surcharge rates.

Old units must be returned within 3 months of the purchase to be eligible for a full surcharge refund. If an old unit returned does not conform to our acceptable specification all or part of that surcharge may not be refunded.

Warranties

The receipt of information from the purchaser and the delivery by the Company of the goods specified in any order does not in any way imply a warranty that the goods will be suitable for the purposes disclosed. The only warranty which the Company makes in connection with the proprietary good supplied. Midland Turbo guarantees its reconditioned product against faulty workmanship and components for 12 months. The warranty agreement is between Midland Turbo and Midland Turbo's customer extending to the end user of the initial sale. If the vehicle or engine that the turbo is fitted to is subsequently sold, the warranty does not automatically pass to the new owner, to continue the warranty the seller must apply to Midland Turbo for consideration to transfer the warranty terms to the new owner.

Warranty is conditional on the vehicle being properly serviced according to the vehicle manufacturers recommendations.

Warranty may be denied in the event of either the turbocharger or the engine being modified to increase power output.

In the event of any goods proving defective during the period of the warranty due to faulty material or workmanship the Company shall, at its option either supply replacement goods or repair such defective goods free of charge.

Save as provided herein all representations, conditions warranties and terms, whether express or implied by common law statute or otherwise, as to the quality condition or fitness for any purpose of the goods are excluded.

Other product, supplied by Midland Turbo from other manufacturers will carry the conditions of guarantee as specificed by that manufacturers will carry the conditions of guarantee as specified by that manufacturer; available on request.

Limit of Liability

In no event shall the Company be liable for any direct, indirect or consequential loss or damage of any kind howsoever caused arising out of the contract of sale or the use of the goods nor for any diminution in value of components consequent upon or resulting from the use of the Company's products. Without prejudice to any of the foregoing, the liability arising out of or connected with any order, or manufacture, sale, delivery, resale or use of any goods covered by any such order including but not limited to, loss or liability arising from breach of contract, shall in no case exceed the unit price of such goods or parts thereof involved in the claim. The limit of liability shall not apply to any claim for death or personal injury resulting from the negligence of the Company.

Turbochargers used for any form of racing are supplied in good faith and on the understanding that no guarantee is given in respect of performance or reliability of the product, either by the manufacturers or Midland Turbo.

Midland Turbo cannot be held responsible for personal injury or damage caused to the engine or vehicle by a failed turbo.

Carriage

Carriage is free of charge. Timed next day and Saturday morning deliveries will be charged according to current rates.

Please contact Midland Turbo when the old unit is ready for collection which is free of charge.
