il diritto di recesso può essere esercitato solo in relazione ai contratti di compravendita di beni o servizi, conclusi a distanza, ovvero fuori dai locali commerciali, tra consumatore e professionista, e solo dal primo nei confronti del secondo, non viceversa. Per consumatore si intende la persona fisica che agisce per scopi estranei all'attività imprenditoriale o professionale eventualmente svolta. Per professionista deve intendersi, invece, la persona fisica o giuridica che agisca nell'esercizio della propria attività commerciale imprenditoriale o professionale. Il venditore deve sempre farsi carico dell'obbligo di comunicare al consumatore la facoltà di esercitare il diritto di recesso.

Il diritto di recesso è irrinunciabile e non assoggettabile a penali o limitazioni. Il suo esercizio non è limitato alle ipotesi di giusta causa, poichè il consumatore può esercitare il diritto di recesso senza essere tenuto a fornire alcuna spiegazione circa i motivi e le cause per cui intende sciogliere il contratto. Ogni clausola contraria, eventualmente presente, sarebbe da considerarsi nulla.

il diritto di recesso può essere esercitato dal momento della conclusione del contratto fino a dieci giorni dopo il ricevimento della merce. Come si esercita il diritto di recesso

Il diritto di recesso si esercita con l'invio entro il termine di dieci giorni di una comunicazione scritta alla sede del professionista mediante lettera raccomandata con avviso di ricevimento. È possibile inviare la comunicazione, entro lo stesso termine, anche mediante telegramma, telex, posta elettronica e fax, a condizione che sia confermata mediante lettera raccomandata con avviso di ricevimento entro le quarantotto ore successive.

Nella raccomandata è sufficiente inserire i propri dati, quelli relativi all'ordine e all'acquisto effettuati, comunicando l'intenzione di recedere dal contratto, con l'intimazione di restituire il prezzo pagato entro il termine tassativo di 30 giorni.

Qualora nell'informativa riguardante il diritto di recesso o nell'offerta di vendita o nelle clausole di contratto, ciò sia espressamente previsto, il consumatore può esercitare il diritto di recesso procedendo alla diretta ed immediata restituzione del bene, senza l'onere della preventiva comunicazione.
