Durante el ano de 1999, primero de su mandato, el presidente de Venezuela Hugo Chavez, llevo a cabo un conjunto de acciones politico-juridicas encaminadas a preparar el camino hacia una Asamblea Nacional Constituyente. En este trabajo, presentado en el XI Simposio de Ciencias Politicas de la Universidad Simon Bolivar, se hace enfasis, en el uso arbitrario que hizo el Presidente Chavez del referendum popular para aprobar dos instrumentos juridicos contrarios a la Constitucion vigente de 1961 y que resultaron fundamentales en su proyecto constituyente, el Decreto N Degrees3 y las Bases Comiciales. La idea principal, gira alrededor de la Base Tercera, que el autor analiza, junto con los denominados Kinos , dentro de la estrategia electoral del gobierno, con el objeto de sacar ventaja en los comicios de 25/7/1999. El resultado fue un fraude electoral y la eleccion de una Asamblea Constituyente carente de legitimidad. La conclusion es que tanto la Asamblea Constituyente, como la Constitucion Bolivariana de 1999, carecen de legitimidad originaria, como tampoco la tendria el primer gobierno de Chavez dentro del nuevo marco constitucional, consecuencia del Proceso Constituyente.
