We will not be liable to you or any third party for any indirect or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused.
 
The products should be used only under strict adult supervision at all times.
Under no circumstances should the products ever be used in areas where other vehicles may be driving.
Under no circumstances should any product be used where there could be danger to a child or adult.
 
Where the products are purchased for use outside the European Community the electrical supply may not be compatible with the products. The purchase of the relevant converters is your obligation.
 
Where the product is delivered to a UK address damaged we will cover the cost of return postage, providing the goods are signed as damaged and refused upon delivery. If the product is returned for any other reason you will be liable for the cost of return postage. We request that you sign that you accept delivery of your product and that you have checked it is received in a condition you are happy with. We cannot be held liable for damage in transit if you have accepted delivery unchecked.
If your product is damaged in transit you must refuse delivery and notify us immediately. We will send a replacement to you.
 
The couriers are contracted to deliver to the kerb of the delivery address. They are not contracted to carry the product beyond the kerb and you may be required to carry the item from the kerb to your premises.
 
If your product develops a fault, Xtreme Bikes offers 30 days free replacement part guarantee from the date of purchase which covers manufactures defects, this does not cover misuse and broken parts which may have been done by the owner/ rider, we will replace manufacturers defect parts only. You will be required to return the faulty part for inspection and re-fit the new part as soon as possible.
 
The manufacturer’s warranty covers normal private usage.
If a product is damaged through user negligence or abuse the warranty will be void.
Batteries are expressly excluded from any guarantee.
Under no circumstances can a refund be made on any used car.
 
If the product needs to be returned for any reason other than damaged in transit, the customer is responsible for all return postage costs, including broken / damaged parts and warranty items. Please note that once our products have been assembled and used. we do not offer a cash refund, but instead we will gladly help with any future parts needed, most parts can be purchased directly from our website.
If parts needed are not listed please send an email and we will quote you a price.
 
If you request an urgent delivery at an extra charge this extra charge is payable even if you subsequently decide to return your product. We cannot refund urgent delivery charges under any circumstances.
 
If you wish to purchase a product for delivery outside mainland UK, we will obtain a quote from reputable shipping companies and inform you of the cost or you can use your own shippers. The importing of a product to a country outside mainland UK is a transaction between you and the shippers. If you need to return the product for any reason whatsoever your shipping charges are not refundable and you will have to bear the cost of return shipping for the product.
If your product has been sent to a location outside mainland UK and it is subject to a warranty claim, you are liable for all shipping associated with getting it fixed or replaced.
 
Beyond our control
 
Xtreme Bikes shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control. All goods are delivered by third party couriers and we are reliant on them. We cannot accept any responsibility if they fail to perform.
 
 
 
Products delivered require a signature to accept they have been received in good order.
 
Delivered products must be inspected before signing acceptance that they are received in good order. If a product arrives damaged the courier must be notified immediately and the product refused. We cannot accept refund claims for goods damaged in transit if you have signed your acceptance they have been received in good order.
 
 
 
 
 
Terms & Conditions
 
These Conditions (as amended from time to time) contain the entire agreement between you and us relating to the subject matter covered and supersede any previous agreements, arrangements, undertakings or proposals, written or oral, between you and us in relation to such matters. No oral explanation or oral information given by either of us shall alter the interpretation of these Conditions. You confirm that, in agreeing to accept these Conditions, you have not relied on any representation save insofar as the same has expressly been made a representation in these Conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not become a term of these Conditions save that your agreement contained in this Clause shall not apply in respect of any fraudulent misrepresentation whether or not such has become a term of these Conditions.
 
LAW The Conditions will be exclusively governed by and construed in accordance with the laws of United Kingdom whose Courts will have exclusive jurisdiction in any dispute save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions. A contract of sale shall be deemed to exist Xtreme Bikes and you when you receive a confirmation of order from us or an invoice. You must check that the order details invoice and delivery address are correct and notify us immediately of any discrepancies. We advise that you print a copy of this confirmation for your own records.
 
Cancellation you may cancel your order with us anytime up to 7 days after day of delivery and any payment made will be refunded, providing the goods have been ordered from stock. You inform us by email with your order number, name and address to cancel. Upon receipt of stock item goods you may return them as mentioned within 7 working days. They goods must be unused and in the original packaging. Providing these conditions are met we will refund the cost of the received goods. Please note this payment does not include the original postage charges or the return postage costs. The customer is responsible for the safe return of all goods and must make sure that the items / items are carefully repackaged in the same manner as they were received. Refunds are made via the same method used for the original payment
 
DESPATCH: We aim to despatch goods within 24hrs of completion of payment process for orders paid by credit/debit card or postal order. Orders paid by cheque will not be despatched before clearance of cheque. We will post items via the delivery method selected however we accept no responsibility for loss, damage or late delivery through no fault of our own. In certain cases it may be possible to claim compensation for lost items however we need to be notified within 7 days that the product has not arrived else we will not be able to claim and you may lose the money spent on that lost item. In the exceptional circumstances where we find we are at fault ie, lost order, we will send the item and as soon as it has been brought to our attention. The following applies to goods ordered over the value of £50 or of a large nature items below will generally be dispatched via our preferred delivery company.
 
 
ALL GOODS OVER £50 are delivered via a carrier service, between 8:30am and 5:30pm Monday - Friday, and require a signature upon receipt and the following applies: UK Mainland Customers - Delivery is made by carrier, If you cannot arrange for someone to be available to sign for the goods, please let us know immediately for an alternative delivery date or alternative delivery address to be scheduled.
UK Offshore Customers/EU Customers - As above except delivery is between 2 - 7 days depending on destination country. You will be notified of an approximate delivery date. International Customers - As above except once posted it is out of our control. Upon ordering a product for international delivery you are accepting that if for any reason the goods are held up or seized at your countries customs it is your responsibility to try and have them released and any costs incurred or loss is accepted by you. You also need to be aware that our delivery costs do not include any duty or taxes that may be payable in your country. If you are not happy with this, with the greatest of respect, please do not order from us!
Delivery charges: These are priced per item based on weight and value; Special rates apply for bulk orders. We reserve the right even after confirming your online order via email to obtain quotes from delivery companies for the cost of delivery of your item and if delivery cost is found to be more than the price previously charged to give you the option to pay the extra to have it delivered or to have a full refund. We will not be obligated to deliver the item at the previously charged price and put us in a loss making situation.
 
 
GOODS ORDERED IN ERROR We will refund monies for any product ordered in error as long as it is returned to us at your expense and it is received in the same New condition that it left us in. If the item is returned to us in a none sellable state we have the right to refuse you a refund.
 
 
Faulty / Damaged Goods You must take responsibility for checking over the goods and unpacking whilst the delivery driver waits if necessary. In the unlikely event that the goods received are faulty or damaged, you must sign for the goods as damaged. If you sign to say that they are received in good condition we must assume that they were in good condition when delivered or you have confirmed acceptance of the goods in this damaged condition and we will not be able to rectify any fault how so ever caused or make any payments of compensation. You must notify us within 24 hours of delivery either by email or telephone or else a damage claim may not be possible. Depending upon the extent of the fault / damage, you may be sent a replacement parts if possible or you will be asked to return the goods in their original packaging (where possible) to our address. In the event you are asked to return the goods, you will be offered a replacement, providing there is no evidence of misuse. Damaged items must be reported within 24 hours of receiving the goods
 
 
WARRANTY For buyers who wish for the item to be returned to them, the postage and packing fee will be required to be paid when the item is returned. Please contact us for a Returns Number before returning any item (sales@xtremebikes.co.uk). When we accept the return of a product for repair, we will where possible use our own labour force to make the repair, however on occasion the item may need to go back to the manufacturer in this instance we ll organise for the product to be sent back to the relevant manufacturer or distributor. Due to the process and logistics involved, it may take up to 6 weeks for a product to be received, sent to the relevant manufacturer for repair, returned to us and then finally sent back to the customer, however the average time is 4 weeks. Servicing & Maintenance In order not to invalidate the manufacturer’s warranty, all vehicles purchased must be regularly maintained in line with the manufacturer’s guidelines. Regular servicing as outlined in the manufacturers handbook (supplied) must be undertaken, service can be carried out by a suitably qualified person and an original invoice of any work carried out MUST be retained. In the event of ANY warranty claim, all of these original documents must be available for inspection in order for the claim process to begin.
 
 
THE WARRNTEE: All warranties offered will be our return to base (RTB) warranty. That is, the customer is responsible for returning the product to our warehouse and collecting the product once it has been repaired. This warranty provides labour if required and new parts free, if the product breaks down due to faulty manufacture or in normal use; we will replace all parts for free. If you require us to mail you replacement parts for DIY fitment that can be arranged however we will not pay for labour by a third party and faulty items will need to be received by us before replacement parts can be sent
 
We offer 30 days warranty on all our products and accessories . All on/off road products and vehicles sold by Xtreme Bikes are supplied with a 30 day free parts guarantee, this means that if any normal part becomes defective within the 30 days of purchase we will replace the defective part/ parts with new ones for free. You will also be required to return the defective part / parts before we can post out any new parts. The Warrantee Does not cover misuse, stunt riding, none servicing and bad Repair or Alterations. Within this period we will replace any non wearable part if it is proven to have a manufacturing fault. Should the part fail due to neglect, abuse, accident, corrosion, lack of regular maintenance or modifications not approved by Xtreme Bikes in writing, then all parts of the warranty will be VOID. Errors and Emissions Excluded. This does not cover:-Inappropriate use, incorrect operation or a fault created through incorrect fitting- (e.g. The warranty does not cover impact damage, hazardous liquid damage, exposure to extreme heat/cold or other damage caused by acts of God or incorrect fitment) or Vandalism- Damage caused by others. Glass & Paint - Any item that contains glass or is painted will be covered but the glass and paint itself cannot be covered under warranty as this is considered Fragile and could be broken, damaged or scratched in numerous ways. Should you remove or require us to remove any item once fitted we will not be held responsible to make good any holes or modifications that were required during the fitting process. As with all Mini Moto products we offer a 30 day parts only warranty. This does not cover Engines seizers and punctures as this could easily be caused by insufficient 2 stroke oil or the terrain the vehicles have been travelling on. Also please note that once the machines have been started and used they cannot be returned for a refund. But we will help with replacement parts wherever possible. Please only purchase one of our products if you understand our warrantee and Guarantee procedure. Due to the nature of use of these machines it would be impossible to warranty beyond the 30 days stated.
 
BEFORE EACH RIDE, All nuts/ bolts, tyres and steering, chain tension, oil mixture, brakes, carburettor, fuel pipes, fuel filters, pull start, spark plug, wiring and all serviceable parts should be checked by a competent adult before every use. It is recommended that a qualified mechanic should assemble and check over all aspects of the product before allowing any persons to use the bike, quad scooter off road. Accident damage should be attended to immediately and damaged parts replaced immediately. Helmets and suitable protective equipment should be used at all times and always use our products under strict adult supervision. The purchaser is responsible for all returned items (RTB). All returned postage costs are to be paid by the winning bidder, and under no circumstances will the returned postage be paid for by Xtreme Bikes.
 
 
 
Legal Declaration and Disclaimer.
 
 
 
Mini bikes, quads, scooters are not ROAD LEGAL and should under no circumstances be used on the public roads. The purchaser is solely responsible for the use of the minimoto and must strictly adhere to all governmental laws that are in force. Do not use on wet, oily or icy surfaces. The minimoto is designed for both adults and children from 16 years upwards, but children should be supervised at all time when riding the bike by a responsible adult.
 
 
Purchaser accepts FULL responsibility & releases Xtreme Bikes, Shane Wood and Claire Wood of ANY and ALL PERSONAL INJURIES, FATAL INJURIES, ANY LOSSES , COSTS, OR DAMAGES incurred as a result of the Purchaser s operation of this item. The purchaser is solely responsible for the maintenance and safety of the minimoto and when permitting other riders to ride this item, and assumes all responsibility in event of damages, injuries or fatal injuries etc... Purchaser is solely responsible for understanding and abiding by all governmental/ police laws for operation of this product
 
 
 
 
RETENTION OF TITLE The legal and equitable title to the goods supplied under the contract (in this condition referred to as the contract goods which expression includes any of them) will not pass to the buyer until the price for the contract goods has been paid in full or until such payment have been received Xtreme Bikes owns all products until the customer accepts the goods upon delivery.
