Angesichts der Entwicklung der Informations- und Kommunikationstechnologien in den letzten Jahrzehnten gewinnt die Erstellung, Verarbeitung und Speicherung von elektronischen Informationen zunehmend an Relevanz. Aufgrund von Privatisierung und Kommerzialisierung des Gutes Information besteht aber die Gefahr einer asymmetrischen Informations- und Wissenslage der Gesellschaft. Als Lösung dieser Wissenskluft wird der allgemeine freie Zugang - Open Access - zu Wissen diskutiert. Konkret ist Open Access eine Bewegung, die einen unentgeltlichen Zugang zu wissenschaftlichen Informationen für jeden Interessierten ohne softwaretechnische Zugangshürden fordert. Der Autor beschreibt den historischen und gesellschaftlichen Hintergrund der Open-Access-Bewegung, zeigt die bisherigen Meilensteine von Open Access auf und untersucht Vor- und Nachteile. Er stellt zudem die aktuellen de lege ferenda-Vorschläge - eine Zwangslizenz, eine Anbietungspflicht (§ 43 Abs. 2 UrhG-E), ein Zweitveröffentlichungsrecht (§ 38 Abs. 1 Satz 3 UrhG-E) und eine Schrankenregelung (§ 52c UrhG-E) - vor und unterzieht diese Regelungen einer rechtlichen Prüfung. Der Autor kommt zu dem Ergebnis, dass lediglich das Zweitveröffentlichungsrecht eines Urhebers verfassungskonform ist.
