Regole di recesso

1. Ai sensi dell'art. 64 e seguenti del D.Lgs. n. 206/2005, se il Cliente è un consumatore (ossia una persona fisica che acquista la merce per scopi non riferibili alla propria attività professionale, ovvero non effettua l'acquisto indicando nel modulo d'ordine un riferimento di Partita IVA), ha diritto a recedere dal contratto di acquisto per non conformità, senza alcuna penalità e fatto salvo quanto indicato al successivo punto 3.

2. Per esercitare tale diritto, il Cliente dovrà APRIRE LA RESTITUZIONE SU EBAY COME OGGETTO ACQUISTATO PER ERRORE

3. Il diritto di recesso è sottoposto alle seguenti inderogabili condizioni:

• il diritto si applica al prodotto acquistato nella sua interezza; non è possibile esercitare recesso solamente su parte del prodotto acquistato

• il diritto non si applica ai prodotti audiovisivi o a software informatici sigillati (compresi quelli allegati a materiale hardware), una volta aperti;

• il bene acquistato dovrà essere integro e restituito nella confezione originale, completa in tutte le sue parti (compresi imballo ed eventuale documentazione e dotazione accessoria: manuali, cavi, ecc...); per limitare danneggiamenti alla confezione originale, raccomandiamo, quando possibile, di inserirla in una seconda scatola, sulla quale apporre il numero di RMA (codice di autorizzazione al rientro) rilasciato da indipendence game snc ; va evitata in tutti i casi l'apposizione di etichette o nastri adesivi direttamente sulla confezione originale del prodotto;

• il bene soggetto a esercizio del diritto di recesso deve essere restituito in normale stato di conservazione, in quanto sia stato custodito ed eventualmente adoperato con l’uso della normale diligenza: non verranno quindi accettati prodotti utilizzati che riportino segni di danneggiamento

• le spese di spedizione relative alla restituzione del bene sono a carico del cliente;

• la spedizione, fino all'attestato di avvenuto ricevimento nel nostro magazzino, è sotto la completa responsabilità del cliente;

• in caso di danneggiamento del bene durante il trasporto, indipendence game snc darà comunicazione al Cliente dell'accaduto (entro 5 giorni lavorativi dal ricevimento del bene nei propri magazzini), per consentirgli di sporgere tempestivamente denuncia nei confronti del corriere da lui scelto e ottenere il rimborso del valore del bene (se assicurato); in questa eventualità, il prodotto sarà messo a disposizione del Cliente per la sua restituzione, contemporaneamente annullando la richiesta di recesso;

• indipendence game snc non risponde in nessun modo per danneggiamenti o furto/smarrimento di beni restituiti con spedizioni non assicurate;

4. Fatte salve eventuali spese di ripristino per danni accertati all'imballo originale, indipendence game snc provvederà a rimborsare al cliente l'intero importo già pagato, entro 14 giorni dal rientro della merce, tramite procedura di storno dell'importo addebitato sulla Carta di Credito a mezzo Paypal .

5. Il diritto di recesso decade totalmente, per mancanza della condizione essenziale di integrità del bene (confezione e/o suo contenuto), nei casi in cui indipendence game snc accerti:

• la mancata apposizione del modulo di autorizzazione rilasciato da indipendence game snc.

sull’involucro esterno della confezione spedita;

• la mancanza della confezione esterna e/o dell'imballo interno originale;

• l'assenza di elementi integranti del prodotto (accessori, cavi, manuali, parti, ...) o anomalie al prodotto stesso;

• il danneggiamento del prodotto per cause diverse dal suo trasporto;

• uno stato di sporcizia del prodotto dovuta al suo utilizzo, che ne abbia compromesso l'integrità. Le spese ed i rischi del trasporto per la restituzione sono integralmente a carico del Cliente. La restituzione di prodotti non integri, deteriorati o privi di accessori e dotazioni originali non sarà accettata da indipendence game snc e verrà restituita al mittente con aggravio di spese di trasporto.
