Teniendo en cuenta que la OCDE ha hecho requerimientos para que todos los paises introduzcan en sus legislaciones un marco de tributacion internacional basado en el principio de transparencia fiscal y en tal sentido se promueva la firma de Acuerdos de Intercambio de Informacion Tributaria (AIIT) como lo establece el Convenio OCDE (Art. 26), el presente libro pretende dar una vision que los esfuerzos de la OCDE y de los Estados vienen enmarcados en una finalidad recaudatoria, por encima de los derechos del contribuyente, no estableciendo como tal una proteccion a lo que se denomina el secreto tributario en la informacion del contribuyente y en muchos casos cuestionando la legimitimidad del derecho a la planificacion fiscal, como fundamento para tomar decisiones de internacionalizacion de sus operaciones basadas en CDI, AIIT, y acuerdos tributarios; por lo que elaboramos un comparativo del marco tributario de fiscalidad internacional entre Colombia y Panama.
