Does not work straight out of the box

Box arrived undamaged but the bb8 robot will not roll and goes straight into system failure mode. Trying to contact company to get a replacement. The kids are very disappointed they cant play with their new toy on christmas. I hope I dont get stuck with an almost $300 dollar paperweight.
